This makes it possible to obtain protection throughout the EU with a single title. In 1998, there were fewer than 25,000 European trademark registrations. At present, 25,000 corresponds to the number of EU trademarks registered within 2 months.<\/p>\n<p>The European Union Trade Mark Office (EUIPO) recently published its <a href=\"https:\/\/euipo.europa.eu\/tunnel-web\/secure\/webdav\/guest\/document_library\/contentPdfs\/about_euipo\/the_office\/statistics-of-european-union-trade-marks_en.pdf\" target=\"_blank\" rel=\"noopener\">statistics on the european brand<\/a>. This document contains data on the Community trade mark from its creation in 1996 until September 2018. Some of these figures need to be analysed here in order to understand the scope of the Community trade mark.<\/p>\n<p>\u00a0<\/p>\n<h2>Deposits in constant increase<\/h2>\n<p>In the first half of the 2000s, EU trademark registrations were fairly stable. Each year, EUIPO registered an average of 35,000 trademarks. It is from 2005 onwards that the European trademark became very popular. In that year, it was close to 60,000 registrations.<\/p>\n<p>There was then a steady increase in registrations (in 2009, the 100,000 mark mark mark was reached, followed by a slight decline in the following years). In 2017, the EUIPO registered 128,331 European trademarks, setting a new record.<\/p>\n<p>It is also interesting to note that deposits are not evenly distributed over the year. For example, the months of April generally have fewer records than the other months. Conversely, May is the month with the highest number of registrations (despite the 1<sup>er<\/sup> May, a public holiday in all European states), followed closely by the months of March and September.<\/p>\n<p>\u00a0<\/p>\n<h2>Stabilisation of oppositions against EU trademarks<\/h2>\n<p>Even though there are more than 100,000 new European trademarks each year, it is surprising to note that the number of oppositions remains relatively stable. In 1998, the EUIPO received approximately 11,000 oppositions, in 2007 there were 16,600 and in 2017 only 18,600. In view of the number of filings, this is an interesting development. This means that an applicant today is much less likely to receive an opposition than 20 years ago.<\/p>\n<p>Indeed, the <a href=\"https:\/\/www.cairn.info\/revue-legicom-1997-3-page-23.htm\" target=\"_blank\" rel=\"noopener\">the beginnings of the community trademark<\/a> have been very well attended. In 1997, when only 1,400 applications for registration had been published, there were already 350 oppositions. Since 2010, the EUIPO receives between 15,000 and 19,000 opposition applications each year.<\/p>\n<p>It is also interesting to note that almost 2\/3 of the oppositions do not result in a decision by EUIPO. They can either be settled by mutual agreement between the parties (by a coexistence agreement in particular) or withdrawn. Indeed, if the opposition is withdrawn before any decision is taken, the opponent may recover part of the costs incurred. For more information on the opposition procedure becomes EUIPO, see<a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/trademark-opposition\/\"> our article on the brand guide<\/a>.<\/p>\n<p>\u00a0<\/p>\n<h2>Typologies of Community trade mark applications<\/h2>\n<p>Word marks made up the majority of EU trademark applications (with approximately 52% of applications between 2016 and 2018). Figurative marks were the next largest category. Non-traditional marks (3D marks, sound marks, colour marks and position marks) occupy only a residual place (less than 1% of applications). However, as these marks have only been eligible for protection since March 2016, it is estimated that they will grow in the coming years.<\/p>\n<p>Similarly, the overwhelming majority (99,85%) of the trademarks registered at EUIPO are individual marks. The <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/the-collective-trademark\/\">collective marks<\/a> and certification are not yet very popular with applicants.<\/p>\n<p>Finally, it is very interesting to note that Germany is the leading applicant for European trademarks, with 315,000 trademarks under its belt, closely followed by the United States (291,000 applications). France is only 6<sup>th<\/sup> place in the ranking, with 123,600 marks. Ce document comporte des donn\u00e9es sur la marque communautaire depuis sa cr\u00e9ation en 1996, jusqu\u2019en septembre 2018. Il convient ici d\u2019analyser certains de ces chiffres pour comprendre l\u2019ampleur de la marque communautaire.&lt;\/p&gt;&lt;p&gt;&nbsp;&lt;\/p&gt;&lt;h2&gt;Des d\u00e9p\u00f4ts en constante augmentation&lt;\/h2&gt;&lt;p&gt;Dans la premi\u00e8re moiti\u00e9 des ann\u00e9es 2000, les d\u00e9p\u00f4ts de marques&nbsp;de&nbsp;l'UE&nbsp;\u00e9taient assez stables. Chaque ann\u00e9e, l\u2019EUIPO enregistrait en moyenne 35&nbsp;000 marques. C\u2019est \u00e0 partir de 2005 que la marque europ\u00e9enne conna\u00eet une grande popularit\u00e9. Elle fr\u00f4le d\u2019ailleurs la barre des 60&nbsp;000 d\u00e9p\u00f4ts cette ann\u00e9e-l\u00e0.&lt;\/p&gt;&lt;p&gt;On note ensuite une augmentation constante des enregistrements (en 2009, la barre des 100&nbsp;000 marques enregistr\u00e9es est atteinte, avant de marquer un l\u00e9ger recul les ann\u00e9es suivantes). En 2017, l\u2019EUIPO a enregistr\u00e9 128&nbsp;331 marques europ\u00e9ennes, marquant un nouveau record.&lt;\/p&gt;&lt;p&gt;Il est \u00e9galement int\u00e9ressant de noter que les d\u00e9p\u00f4ts ne sont pas r\u00e9partis de mani\u00e8re uniforme sur une ann\u00e9e. Ainsi, les mois d\u2019avril comptent en g\u00e9n\u00e9ral moins d\u2019enregistrements que les autres mois. A l\u2019inverse, le mois de mai tient la t\u00eate du classement (malgr\u00e9 le 1&lt;sup&gt;er&lt;\/sup&gt; mai, f\u00e9ri\u00e9 dans tous les Etats europ\u00e9ens), suivi de pr\u00e8s par les mois de mars et de septembre.&lt;\/p&gt;&lt;p&gt;&nbsp;&lt;\/p&gt;&lt;h2&gt;Une stabilisation des oppositions contre les marques de l\u2019UE&lt;\/h2&gt;&lt;p&gt;Alors m\u00eame que l\u2019on compte chaque ann\u00e9e plus de 100&nbsp;000 nouvelles marques europ\u00e9ennes, il est surprenant de noter que le nombre d\u2019oppositions reste relativement stable. En 1998, l\u2019EUIPO recevait environ 11&nbsp;000 oppositions, en 2007 on en comptait 16&nbsp;600 et en 2017 seulement 18&nbsp;600. Au regard du nombre de d\u00e9p\u00f4ts, cette \u00e9volution est int\u00e9ressante. Cela signifie qu\u2019aujourd\u2019hui un d\u00e9posant risque beaucoup moins de recevoir une opposition qu\u2019il y a 20 ans.&lt;\/p&gt;&lt;p&gt;En effet, les &lt;a href=\"https:\/\/www.cairn.info\/revue-legicom-1997-3-page-23.htm\"&gt;d\u00e9buts de la marque communautaire&lt;\/a&gt; ont \u00e9t\u00e9 tr\u00e8s suivis. En 1997, alors que seulement 1400 demandes d\u2019enregistrement avaient \u00e9t\u00e9 publi\u00e9es, on comptait d\u00e9j\u00e0 350 oppositions. Depuis 2010, l\u2019EUIPO re\u00e7oit chaque ann\u00e9e entre 15 000 et 19&nbsp;000 demandes d\u2019oppositions.&lt;\/p&gt;&lt;p&gt;Il est aussi int\u00e9ressant de relever que pr\u00e8s de 2\/3 des oppositions n\u2019aboutissent pas \u00e0 une d\u00e9cision de l\u2019EUIPO. Elles peuvent soit \u00eatre r\u00e9gl\u00e9es d\u2019un commun accord entre les parties (par un accord de coexistence notamment), soit faire l\u2019objet d\u2019un retrait. En effet, si l\u2019opposition est retir\u00e9e avant toute d\u00e9cision, l\u2019opposant peut recouvrir une partie des frais engag\u00e9s. On trouve ensuite les marques figuratives.
