Infringement can occur in the case of an identical reproduction of a trademark, but also in the case of more or less crude imitations. In this article, we will look back at three high-profile counterfeiting cases. Then we will give you our advice on how to avoid finding yourself in a similar situation.<\/p>\n<p>\u00a0<\/p>\n<h2>1.      Louis Vuitton vs Louisvui Tondak (South Korea)<\/h2>\n<p>In that case, Louis Vuitton discovered a South Korean fried chicken restaurant.\"\u00a0<a href=\"http:\/\/www.fashionforwardtrends.com\/news\/louis-vuitton-louisvui-tondak\/\" target=\"_blank\" rel=\"noopener\">Louis Vuiton Dak\u00a0<\/a>\u00bb. Apart from the violation of the name, the logo and packaging of the restaurant were very strongly similar to those of the French designer. For Louis Vuitton, the proximity to a fried chicken restaurant was an attack on its image. The Korean restaurant therefore chose to change its name to \"LOUISVUI TONDAK\" (\"Tondak\" meaning \"whole chicken\" in Korean). However, this change was not enough. The judges ordered the restaurateur to pay a<\/p>\n<h2>2.\u00a0\u00a0\u00a0\u00a0\u00a0<a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/10\/3M.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/10\/3M-300x160.jpg\" alt=\"\" width=\"54\" height=\"29\" \/><\/a> \u00a0against <a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/10\/YM.png\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/10\/YM.png\" alt=\"\" width=\"70\" height=\"29\" \/><\/a>\u00a0(China)<\/h2>\n<p>3M is an American company with varied activities. It markets products ranging from telephone accessories to water purifiers. 3M was established in China in the 1980s and has registered several trademarks, which, given their success, have been copied. As early as 2015, 3M had already won its counterfeiting lawsuit against a Chinese brand \"3N\", which produced products similar to its own. More recently, 3M was confronted with the registration of a brand name \"3N\". <a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/10\/YM.png\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/10\/YM.png\" alt=\"\" width=\"65\" height=\"27\" \/><\/a>which was used for water fountains in the following form: <a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/10\/3M-chine.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/10\/3M-chine.jpg\" alt=\"\" width=\"48\" height=\"36\" \/><\/a>.<\/p>\n<p>The judges condemned the opponent who used the mark in a form not conforming to its registration, which constituted an infringement of the 3M mark. In addition, the Chinese court took into account the notoriety of the 3M trademark to sanction the Chinese applicant.<\/p>\n<h2>3.      Adidas v. Forever 21 (United States)<\/h2>\n<p>The German trade mark Adidas recently opposed Forever 21, the clothing distributor, because some of its products had a design consisting of 3 stripes. According to Adidas, the use of that design constituted an infringement and a dilution of its trade mark. Forever 21 was also attacked for unfair competition and deceptive trade practices.<\/p>\n<p>However, the US distributor contested this complaint, recalling that since 2006, Adidas has systematically monitored the clothes offered for sale by Forever 21 and opposes any marketing of clothing with stripes (even when these are purely decorative).<\/p>\n<p>Adidas is actively defending its brands in the United States. The sports brand has already sued Ecco, Marc Jacobs and Tesla for infringement.<\/p>\n<p><a href=\"https:\/\/us.fashionnetwork.com\/news\/Adidas-settles-trademark-case-with-Forever21,901375.html\" target=\"_blank\" rel=\"noopener\">This case was finally settled out of court between Forever 21 and Adidas.<\/a>. The terms of the settlement have not been made public.<\/p>\n<p>\u00a0<\/p>\n<h2>How to avoid an infringement lawsuit?<\/h2>\n<p>Most infringement lawsuits can be avoided with inexpensive means: prior art searches and trademark monitoring.<\/p>\n<h3>On the counterfeiter's side: the search for anteriorities<\/h3>\n<p>The cases cited above revealed the counterfeiter's bad faith. But it also happens that the counterfeiter is not aware of his mistake at the time of filing. Elle commercialise des produits, allant des accessoires de t\u00e9l\u00e9phone aux purificateurs d\u2019eau. 3M s\u2019est implant\u00e9e en Chine dans les ann\u00e9es 1980 et a d\u00e9pos\u00e9 plusieurs marques, qui compte tenu de leur succ\u00e8s, ont \u00e9t\u00e9 copi\u00e9es. En 2015 d\u00e9j\u00e0, la soci\u00e9t\u00e9 3M avait gagn\u00e9 son proc\u00e8s en contrefa\u00e7on contre une marque chinoise \u00ab&nbsp;3N&nbsp;\u00bb, qui produisait des produits proches des siens. En outre, la cour chinoise a retenu la notori\u00e9t\u00e9 de la marque 3M pour sanctionner le d\u00e9posant chinois.&lt;\/p&gt;&lt;h2&gt;3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Adidas v. Forever 21 (Etats-Unis)&lt;\/h2&gt;&lt;p&gt;La marque allemande Adidas s\u2019est r\u00e9cemment oppos\u00e9e \u00e0 Forever 21, le distributeur de v\u00eatements, car certains de ses produits comportaient un design constitu\u00e9 de 3 bandes. Selon Adidas, l\u2019utilisation de ce motif constituait une contrefa\u00e7on et une dilution de se marque. Forever 21 \u00e9tait \u00e9galement attaqu\u00e9 pour concurrence d\u00e9loyale et pratiques commerciales trompeuses.&lt;\/p&gt;&lt;p&gt;Le distributeur am\u00e9ricain a cependant contest\u00e9 cette plainte, en rappelant que depuis 2006, Adidas surveille syst\u00e9matiquement les v\u00eatements propos\u00e9s \u00e0 la vente par Forever 21 et s\u2019oppose \u00e0 toute commercialisation de v\u00eatements \u00e0 bandes (m\u00eame lorsque celles-ci sont uniquement d\u00e9coratives).&lt;\/p&gt;&lt;p&gt;Adidas d\u00e9fend en effet activement ses marques aux Etats-Unis. La marque de sports a d\u00e9j\u00e0 poursuivi Ecco, Marc Jacobs et Tesla pour atteinte \u00e0 ses droits.&lt;\/p&gt;&lt;p&gt;&lt;a href=\"https:\/\/us.fashionnetwork.com\/news\/Adidas-settles-trademark-case-with-Forever21,901375.html\"&gt;Cette affaire a finalement \u00e9t\u00e9 r\u00e9gl\u00e9e \u00e0 l\u2019amiable entre Forever 21 et Adidas&lt;\/a&gt;. Les termes du r\u00e8glement n\u2019ont pas \u00e9t\u00e9 rendus publics.&lt;\/p&gt;&lt;p&gt;&nbsp;&lt;\/p&gt;&lt;h2&gt;Comment \u00e9viter un proc\u00e8s en contrefa\u00e7on&nbsp;?&lt;\/h2&gt;&lt;p&gt;La plupart des proc\u00e8s en contrefa\u00e7on peuvent \u00eatre \u00e9vit\u00e9s avec des moyens peu co\u00fbteux&nbsp;: la recherche d\u2019ant\u00e9riorit\u00e9s et la surveillance des marques d\u00e9pos\u00e9es.&lt;\/p&gt;&lt;h3&gt;Du c\u00f4t\u00e9 du contrefacteur&nbsp;: la recherche d\u2019ant\u00e9riorit\u00e9s&lt;\/h3&gt;&lt;p&gt;Les affaires cit\u00e9es ci-dessus ont fait appara\u00eetre la mauvaise foi du contrefacteur. Mais il arrive \u00e9galement que ce dernier ne soit pas conscient de son erreur au moment du d\u00e9p\u00f4t. Pour \u00e9viter une contrefa\u00e7on \u00ab&nbsp;par ignorance&nbsp;\u00bb, il est indispensable de faire une recherche parmi les marques, les soci\u00e9t\u00e9s et les noms de domaine ant\u00e9rieurs.&lt;\/p&gt;&lt;p&gt;Une telle recherche, lorsqu\u2019elle est bien faite, pr\u00e9sente des co\u00fbts et peut \u00eatre fastidieuse.
