For 5 years, Louboutin had been claiming the exclusivity of the scarlet soles, victims of their success. Indeed, many competitors use this feature for their own heel shoes.\u00a0<\/strong><\/p>\n<p>The decision just came down. Ending a lawsuit that began in 2013, the European Court of Justice (ECJ) ruled that the colour red on the sole of a shoe is a \"position mark\".<\/p>\n<p><strong>Christian Louboutin <\/strong>had the idea of its famous soles in 1993 when the \"Thought\" pump model was created. Inspired by Andy Warhol and pop art, <strong>Louboutin<\/strong> had then borrowed <a href=\"https:\/\/www.marieclaire.com\/beauty\/news\/a10228\/christian-louboutin-launches-nail-polish\/\" target=\"_blank\" rel=\"noopener\">his assistant's nail polish<\/a> to lacquer the soles.<\/p>\n<p>Let's go back to this dispute, which is full of twists and turns.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<h2><strong>Louboutin versus Van Haren<\/strong><\/h2>\n<p>In 2012, the Dutch company Van Haren will market shoes with red soles. <strong>Louboutin<\/strong> does not look favourably upon it and initiates an infringement action in the Dutch courts. He is asserting a trademark registered in the Benelux in 2013. It combines high-heeled shoes with a red sole:<\/p>\n<p><a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/Marque-Louboutin.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-2785\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/Marque-Louboutin-150x150.jpg\" alt=\"Marque-Louboutin-sole-red\" width=\"150\" height=\"177\" srcset=\"https:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/Marque-Louboutin-254x300.jpg 254w, https:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/Marque-Louboutin-10x12.jpg 10w, https:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/Marque-Louboutin.jpg 421w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/><\/a><\/p>\n<p>According to Van Haren, the combination registered by <strong>Louboutin<\/strong> is contrary to European trademark law.<\/p>\n<p>The Hague Court in the Netherlands, avoiding making a decision, chose to turn to the ECJ.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>The red sole monopoly: a complex issue<\/strong><\/h2>\n<p>For the Netherlands court, the mark at issue is inseparably linked to a shoe sole. However, it does not know whether such a position mark may also encompass colours.<\/p>\n<p>Already in 2012, the <a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000025963595\" target=\"_blank\" rel=\"noopener\">Court of Cassation<\/a> French had stated that neither the shape nor the colour of the red sole was protectable as a trade mark. Christian<strong> Louboutin <\/strong>then blamed Zara for imitating her famous scarlet sole.<\/p>\n<p><a href=\"http:\/\/curia.europa.eu\/juris\/document\/document.jsf?text=&amp;docid=192069&amp;doclang=FR\" target=\"_blank\" rel=\"noopener\">The Advocate General of the ECJ<\/a>Maciej Szpunar, also believes that <strong>Louboutin<\/strong> does not have exclusivity on the red soles. Indeed, it considers that \"<em>\u00a0a trademark that combines colour and shape may be refused or cancelled on the grounds provided for in European Union trademark law. \u00bb<\/em> He doubts above all <em>\"that the color red may fulfill the essential function of the mark\"... <\/em>(identification of the origin of the product). <em>\u00a0<\/em><\/p>\n<p>For him, other shoemakers are allowed to make red-soled heels. However, this opinion is only advisory: it is not a decision of the Court.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>A high heel with a red sole can be a mark<\/strong><\/h2>\n<p>On 12 June, the European judges made their decision. The distinctive sign \"\u00a0<em>consisting of a colour applied to the sole of a high-heeled shoe\".\u00a0<\/em>is not <em>\"consisting exclusively of form\".<\/em><\/p>\n<p>Thanks to this decision, which is binding on Hague judges, Christian <strong>Louboutin<\/strong> wins his case in the Netherlands. His brand also emerges strengthened. Indeed, this judgment could be taken up throughout the European Union and allow <strong>Louboutin<\/strong> to win the dozen lawsuits currently in progress.<\/p>\n<p><strong>On the occasion of this dispute, the European judges were able to rule on the importance of <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/distinctive-and-descriptive\/\">the distinctiveness of the mark<\/a>. A fundamental criterion, regardless of <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/figurative-and-semi-figurative-word-marks-different-types-of-marks\/\">the type of brand<\/a> concerned.<\/strong><\/p>","protected":false},"excerpt":{"rendered":"<p>Louboutin : le chausseur obtient enfin le monopole sur les semelles rouges !
