When a company expands its business in the United States, protection of its trademark in this country is essential.<\/strong><\/p>\n<p>Several systems exist to protect a <strong>brand <\/strong>at <strong>North America.<\/strong> Indeed, two solutions are offered to structures wishing to try the American adventure: directly deposit a <strong>brand<\/strong> <strong>in the US<\/strong> or designate this territory in a <strong>international brand.<\/strong><\/p>\n<p>Which option should you choose to secure your products and services? How to make deposits? What are the conditions?<\/p>\n<h2><strong>The national registration of the trademark in the United States<\/strong><\/h2>\n<p><a href=\"https:\/\/www.uspto.gov\/trademark\" target=\"_blank\" rel=\"noopener\">The U.S. Patent and Trademark Office<\/a> (USPTO - United States Patent and Trademark Office) offers two types of use-based filings and two types of registration.<\/p>\n<h3><strong>Filing on the basis of Intent-to-Use or \"Intent-to-Use Application\".<\/strong><\/h3>\n<p>It is possible to protect a <strong>brand <\/strong>filed in the Main Registry (offering optimum protection for a<strong> brand<\/strong> distinctive), while it has not been exploited in the US market, but will be in the future. At the time of filing, the registrant declares on his or her honour that he or she intends to commence serious exploitation of his or her <strong>brand<\/strong> within six months of the date of filing. This <strong>brand<\/strong> is protected for 10 years, renewable indefinitely, subject to payment of renewal fees.<\/p>\n<p>After filing, the USPTO sends a Notice of Allowance to the owner. The Office then publishes the <strong>brand<\/strong> to allow the interested third party to file an opposition. A period of 6 months starts from the date of notification of the notice.<\/p>\n<p>When it expires, there are two possible situations:<\/p>\n<ul>\n<li>the depositor used his <strong>brand in the U.S.A.<\/strong> It informs the U.S. Office, which will definitively register the <strong>brand<\/strong>\u00a0;<\/li>\n<li>the cardholder has not used his\/her <strong>brand<\/strong> for \"legitimate\" reasons. It then requests an extension of the time limit in 6-month increments, up to a maximum of 3 years from the date of transmission of the notice. The USPTO proceeds with registration as soon as it receives proof of the use of the <strong>mark.<\/strong><\/li>\n<\/ul>\n<h3><strong>The filing based on prior use or \"Use in Commerce Application\".<\/strong><\/h3>\n<p>This protection system allows the monopoly operation of a <strong>brand <\/strong>and therefore a quick check-in. The applicant must, however, provide proof of the use of the name or sign on the date of filing. This proof is sometimes difficult to provide. Indeed, the holder has the obligation to provide proof of the actual prior use by specimens (sale to the public of goods and services under the name or sign). <strong>brand<\/strong> or advertisements mentioning said <strong>brand<\/strong>).<\/p>\n<p>The USPTO admits evidence of the use of a <strong>brand<\/strong> when:<\/p>\n<ul>\n<li>the <strong>brand<\/strong> is inscribed on the products or packaging of the articles or is related to the products and services ;<\/li>\n<li>and that the products and services to which the <strong>brand <\/strong>are sold in a minimum of two states in <strong>USA.<\/strong><\/li>\n<\/ul>\n<p>After providing these supporting documents, the filing procedure shall continue until the registration of the said <strong>mark.<\/strong><\/p>\n<p>A federal registration of <strong>brand<\/strong> with the USPTO allows you to be protected in all <strong>United States<\/strong>. A filing in the principal register provides optimal protection when the registrant demonstrates continued use of the <strong>brand <\/strong>for 5 years and that the sign is distinctive (not descriptive of the goods and services concerned). If the <strong>brand<\/strong> is not sufficiently distinctive, it may be registered in the supplemental register conferring limited protection (no presumption of ownership of the <strong>brand<\/strong>).<\/p>\n<p>An alternative to the national deposit: the applicant can opt for the <strong>international brand.<\/strong><\/p>\n<h2><strong>The international trademark application for the USA<\/strong><\/h2>\n<p>The holder may extend his <strong>French trademark<\/strong> by means of a <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/register-an-international-trademark\/\"><strong>world brand<\/strong><\/a> designating <strong>United States<\/strong> at the WIPO (World Intellectual Property Organization). Filing this application within the 6-month priority period allows you to benefit from the filing date of the <strong>French trademark<\/strong> and to oppose any competing filing made in the meantime.<\/p>\n<p>WIPO translates the application into English and files it with the USPTO.<\/p>\n<p>This filing is based on intent to use and requires a declaration of intent to use, which is not accompanied by evidence. The first proofs must be submitted in the sixth year following the registration of the <strong>mark.<\/strong> It is protected for ten years and renewable forever, if it is exploited.<\/p>\n<p>The difficulty of the American system will be quickly overcome with the help of a patent attorney and a judicious choice of filing will result.<\/p>","protected":false},"excerpt":{"rendered":"<p>La marque aux \u00c9tats-Unis Comment d\u00e9poser sa marque aux \u00c9tats-Unis\u00a0? Quelles sont les conditions&nbsp;?&lt;\/p&gt;&lt;h2&gt;&lt;strong&gt;Le d\u00e9p\u00f4t national de la marque aux \u00c9tats-Unis&lt;\/strong&gt;&lt;\/h2&gt;&lt;p&gt;&lt;a href=\"https:\/\/www.uspto.gov\/trademark\"&gt;L\u2019Office am\u00e9ricain des marques et des brevets&lt;\/a&gt; (USPTO \u2013 United States Patent and Trademark Office) propose deux types de d\u00e9p\u00f4ts bas\u00e9s sur l\u2019usage et deux sortes d\u2019enregistrement.&lt;\/p&gt;&lt;h3&gt;&lt;strong&gt;Le d\u00e9p\u00f4t sur la base de l\u2019intention d\u2019usage ou \u00ab&nbsp;Intent-to-Use Application&nbsp;\u00bb&lt;\/strong&gt;&lt;\/h3&gt;&lt;p&gt;Il est possible de prot\u00e9ger une &lt;strong&gt;marque &lt;\/strong&gt;d\u00e9pos\u00e9e sur le Registre Principal (offrant une protection optimum pour une&lt;strong&gt; marque&lt;\/strong&gt; distinctive), alors qu\u2019elle n\u2019a pas \u00e9t\u00e9 exploit\u00e9e sur le march\u00e9 am\u00e9ricain, mais qu\u2019elle le sera \u00e0 l\u2019avenir. Au moment du d\u00e9p\u00f4t, le titulaire d\u00e9clare sur l\u2019honneur qu\u2019il a l\u2019intention de d\u00e9buter l\u2019exploitation s\u00e9rieuse de sa &lt;strong&gt;marque&lt;\/strong&gt; dans les six mois de la date du d\u00e9p\u00f4t. Cette &lt;strong&gt;marque&lt;\/strong&gt; b\u00e9n\u00e9ficie d\u2019une protection de 10 ans, renouvelable ind\u00e9finiment, sous r\u00e9serve de r\u00e9gler les taxes de renouvellement.&lt;\/p&gt;&lt;p&gt;Apr\u00e8s le d\u00e9p\u00f4t, l\u2019USPTO transmet un avis d\u2019acceptation (\u00ab&nbsp;Notice of Allowance) au propri\u00e9taire. L\u2019office publie ensuite la &lt;strong&gt;marque&lt;\/strong&gt; pour permettre au tiers int\u00e9ress\u00e9 de d\u00e9poser une opposition. Un d\u00e9lai de 6 mois d\u00e9marre \u00e0 partir de la date de la notification de l\u2019avis.&lt;\/p&gt;&lt;p&gt;\u00c0 son expiration, deux situations sont envisageables&nbsp;:&lt;\/p&gt;&lt;ul&gt;&lt;li&gt;le d\u00e9posant a utilis\u00e9 sa &lt;strong&gt;marque aux USA.&lt;\/strong&gt; Il informe l\u2019Office am\u00e9ricain, qui enregistrera d\u00e9finitivement la &lt;strong&gt;marque&lt;\/strong&gt;&nbsp;;&lt;\/li&gt;&lt;li&gt;le titulaire n\u2019a pas utilis\u00e9 sa &lt;strong&gt;marque&lt;\/strong&gt; pour des motifs \u00ab&nbsp;l\u00e9gitimes&nbsp;\u00bb. Il demande alors la prorogation du d\u00e9lai par tranches de 6 mois, dans une limite de 3 ans \u00e0 partir de la transmission de l\u2019avis. L\u2019USPTO proc\u00e8de \u00e0 l\u2019enregistrement d\u00e8s qu\u2019il re\u00e7oit la preuve de l\u2019usage de la &lt;strong&gt;marque.&lt;\/strong&gt;&lt;\/li&gt;&lt;\/ul&gt;&lt;h3&gt;&lt;strong&gt;Le d\u00e9p\u00f4t fond\u00e9 sur l\u2019usage ant\u00e9rieur ou \u00ab&nbsp;Use in Commerce Application&nbsp;\u00bb&lt;\/strong&gt;&lt;\/h3&gt;&lt;p&gt;Ce syst\u00e8me de protection permet d\u2019avoir le monopole d\u2019exploitation d\u2019une &lt;strong&gt;marque &lt;\/strong&gt;et donc un enregistrement rapide. Le d\u00e9posant doit cependant apporter la preuve de l\u2019usage de la d\u00e9nomination ou du signe \u00e0 la date du d\u00e9p\u00f4t. Cette preuve est parfois difficile \u00e0 fournir. En effet, le titulaire a l\u2019obligation de d\u00e9livrer la preuve de l\u2019utilisation ant\u00e9rieure effective par des sp\u00e9cimens (vente au public de produits et services sous cette &lt;strong&gt;marque&lt;\/strong&gt; ou publicit\u00e9s mentionnant ladite &lt;strong&gt;marque&lt;\/strong&gt;).&lt;\/p&gt;&lt;p&gt;L\u2019USPTO admet la preuve de l\u2019usage d\u2019une &lt;strong&gt;marque&lt;\/strong&gt; quand&nbsp;:&lt;\/p&gt;&lt;ul&gt;&lt;li&gt;la &lt;strong&gt;marque&lt;\/strong&gt; est inscrite sur les produits ou l\u2019emballage des articles ou qu\u2019elle est reli\u00e9e aux produits et services&nbsp;;&lt;\/li&gt;&lt;li&gt;et que les produits et services sur lesquels est appos\u00e9e la &lt;strong&gt;marque &lt;\/strong&gt;sont vendus dans deux \u00c9tats minimum aux &lt;strong&gt;USA.&lt;\/strong&gt;&lt;\/li&gt;&lt;\/ul&gt;&lt;p&gt;Apr\u00e8s avoir fourni ces justificatifs, la proc\u00e9dure de d\u00e9p\u00f4t continue jusqu\u2019\u00e0 l\u2019enregistrement de ladite &lt;strong&gt;marque.&lt;\/strong&gt;&lt;\/p&gt;&lt;p&gt;Un enregistrement f\u00e9d\u00e9ral de &lt;strong&gt;marque&lt;\/strong&gt; aupr\u00e8s de l\u2019USPTO permet d\u2019\u00eatre prot\u00e9g\u00e9 dans tous les &lt;strong&gt;\u00c9tats-Unis&lt;\/strong&gt;. Un d\u00e9p\u00f4t sur le registre principal (\u00ab&nbsp;principal register&nbsp;\u00bb) donne une protection optimale quand le titulaire apporte la preuve d\u2019un usage continu de la &lt;strong&gt;marque &lt;\/strong&gt;durant 5 ans et que le signe est distinctif (non descriptif des produits et services vis\u00e9s). Si la &lt;strong&gt;marque&lt;\/strong&gt; n\u2019est pas suffisamment distinctive, son enregistrement pourra se r\u00e9aliser sur le registre additionnel (\u00ab&nbsp;supplemental register&nbsp;\u00bb) conf\u00e9rant une protection limit\u00e9e (absence de pr\u00e9somption de titularit\u00e9 de la &lt;strong&gt;marque&lt;\/strong&gt;).&lt;\/p&gt;&lt;p&gt;Une alternative au d\u00e9p\u00f4t national : le d\u00e9posant peut opter pour la &lt;strong&gt;marque internationale.&lt;\/strong&gt;&lt;\/p&gt;&lt;h2&gt;&lt;strong&gt;Le d\u00e9p\u00f4t de la marque internationale visant les USA&lt;\/strong&gt;&lt;\/h2&gt;&lt;p&gt;Le titulaire peut \u00e9tendre sa &lt;strong&gt;marque fran\u00e7aise&lt;\/strong&gt; par le biais d\u2019une &lt;a href=\"http:\/\/depot-de-marque.com\/guide-marques\/enregistrer-une-marque-internationale\"&gt;&lt;strong&gt;marque internationale&lt;\/strong&gt;&lt;\/a&gt; d\u00e9signant les &lt;strong&gt;\u00c9tats-Unis&lt;\/strong&gt; aupr\u00e8s de l\u2019OMPI (Organisation Mondiale de la Propri\u00e9t\u00e9 Intellectuelle). R\u00e9aliser ce d\u00e9p\u00f4t dans le d\u00e9lai de priorit\u00e9 de 6 mois permet de b\u00e9n\u00e9ficier de la date de d\u00e9p\u00f4t de la &lt;strong&gt;marque fran\u00e7aise&lt;\/strong&gt; et de s\u2019opposer \u00e0 un \u00e9ventuel d\u00e9p\u00f4t concurrent effectu\u00e9 dans l\u2019intervalle.&lt;\/p&gt;&lt;p&gt;L\u2019OMPI traduit la demande en anglais et proc\u00e8de au d\u00e9p\u00f4t aupr\u00e8s de l\u2019USPTO.&lt;\/p&gt;&lt;p&gt;Ce d\u00e9p\u00f4t se base sur l\u2019intention d\u2019usage et n\u00e9cessite une d\u00e9claration d\u2019intention d\u2019usage, qui n'est pas accompagn\u00e9e de preuves.
