From this imperative was born the \"Madrid system\", the result of two international texts, the Madrid Protocol and the Madrid Agreement. Managed by WIPO (the World Intellectual Property Organization), the Madrid System allows any individual or legal entity to extend the protection of its trademark abroad while greatly facilitating the procedures.<\/p>\n<h2>A centralized repository<\/h2>\n<p>Unlike the European trademark, the international trademark is not a unitary title: not all countries are members of the Madrid system, and it is necessary to choose the countries in which protection is desired. Indeed,<a href=\"http:\/\/www.wipo.int\/madrid\/fr\/\" data-cke-saved-href=\"http:\/\/www.wipo.int\/madrid\/fr\/\" data-cke-saved- target=\"_blank\" rel=\"noopener\"> the Madrid system offers<\/a> simply a single procedure, the latter giving rise to a series of national trademarks studied on a case-by-case basis by the countries concerned. The advantage of the Madrid system therefore lies in its centralization: the applicant only has to submit a single file to a common office, WIPO, without having to draft it in several languages or pay a registration fee in each country. The costs of filing an international trademark application are in fact globalized to form a single fee, which is more advantageous from a certain number of countries.<\/p>\n<p>More than a financial gain, the Madrid system offers the applicant not only a saving in time but also in administrative procedures. On the other hand, the validity of the registered trademark will be examined by each of the countries concerned, whose response may vary according to the rules in force and, above all, any opposable prior rights. As the title of an international trademark is not unitary, a negative response in one country does not in any way call into question applications made in other countries.<\/p>\n<h2>National trademark and priority period<\/h2>\n<p>Again in opposition to the Community trade mark, <a href=\"http:\/\/depot-de-marque.com\/en\/deposit-rates\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/tarifs-depot\" data-cke-saved->the registration of an international trademark<\/a> must necessarily be preceded by the registration of a national trademark. It is only after this step that it will be possible to extend it to the international level, directly through the INPI. It is therefore not surprising to note that the two marks, national and international, are closely linked during the first 5 years following the registration of the latter. If the national trademark ceases to have effect for any reason whatsoever, the international trademark will suffer the same fate and will be cancelled.<\/p>\n<p>What is the priority delay? The priority period provides the applicant with an additional period of time to think about whether or not it is appropriate to file an international trademark application. It begins on the French filing date and runs for a period of 6 months; if the international trademark is filed during this period, it will then be considered as having been filed at the same time as the national trademark, and applications filed by third parties during this period cannot be opposed to it. G\u00e9r\u00e9 par l'OMPI (l'Organisation mondiale de la propri\u00e9t\u00e9 intellectuelle), le syst\u00e8me de Madrid permet \u00e0 tout particulier ou personne morale d'\u00e9tendre la protection de sa marque \u00e0 l'\u00e9tranger tout en facilitant grandement les d\u00e9marches.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Un d\u00e9p\u00f4t centralis\u00e9&lt;\/h2&gt;&lt;p&gt;A l'inverse de la marque europ\u00e9enne, la marque internationale n'est pas un titre unitaire : tous les pays ne sont pas membres du syst\u00e8me de Madrid, et il est n\u00e9cessaire de choisir les pays dans lesquels une protection est souhait\u00e9e. De fait,&lt;a href=\"http:\/\/www.wipo.int\/madrid\/fr\/\" data-cke-saved-href=\"http:\/\/www.wipo.int\/madrid\/fr\/\"&gt; le syst\u00e8me de Madrid propose&lt;\/a&gt; simplement une proc\u00e9dure unique, cette derni\u00e8re donnant naissance \u00e0 une s\u00e9rie de marques nationales \u00e9tudi\u00e9es au cas par cas par les pays concern\u00e9s. L'avantage du syst\u00e8me de Madrid r\u00e9side donc dans la centralisation : le demandeur ne doit pr\u00e9senter qu'un seul dossier aupr\u00e8s d'un office commun, l'OMPI, sans avoir \u00e0 le r\u00e9diger en plusieurs langues ou \u00e0 payer une taxe d'enregistrement dans chaque pays. Les frais \u00e0 engager pour le d\u00e9p\u00f4t d'une marque internationale sont en effet globalis\u00e9s pour ne former qu'une unique redevance, laquelle s'av\u00e8re plus avantageuse \u00e0 partir d'un certain nombre de pays.&lt;\/p&gt;&lt;p&gt;Plus qu'un gain financier, le syst\u00e8me de Madrid offre ainsi au demandeur une \u00e9conomie de temps mais aussi de d\u00e9marches administratives. La validit\u00e9 de la marque d\u00e9pos\u00e9e sera en revanche examin\u00e9e par chacun des pays vis\u00e9s, dont la r\u00e9ponse peut varier selon les r\u00e8gles en vigueur et surtout les \u00e9ventuelles ant\u00e9riorit\u00e9s opposables. Le titre d'une marque internationale n'\u00e9tant pas unitaire, une r\u00e9ponse n\u00e9gative dans un pays ne remet nullement en cause les demandes formul\u00e9es dans d'autres pays.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Marque nationale et d\u00e9lai de priorit\u00e9&lt;\/h2&gt;&lt;p&gt;Une nouvelle fois en opposition avec la marque communautaire, &lt;a href=\"http:\/\/depot-de-marque.com\/tarifs-depot\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/tarifs-depot\"&gt;le d\u00e9p\u00f4t d'une marque internationale&lt;\/a&gt; doit n\u00e9cessairement \u00eatre pr\u00e9c\u00e9d\u00e9 par l'enregistrement d'une marque nationale. Ce n'est qu'apr\u00e8s cette \u00e9tape qu'il sera possible de l'\u00e9tendre \u00e0 l'international, en passant directement par l'INPI. Il n'est donc pas \u00e9tonnant de constater que les deux marques, nationale et internationale, se voient intimement li\u00e9es durant les 5 premi\u00e8res ann\u00e9es suivant le d\u00e9p\u00f4t de cette derni\u00e8re. Si la marque nationale cesse de produire ses effets pour quelque raison que ce soit, la marque internationale conna\u00eetra le m\u00eame sort et se verra radi\u00e9e.&lt;\/p&gt;&lt;p&gt;Qu'est-ce que le d\u00e9lai de priorit\u00e9 ? Le d\u00e9lai de priorit\u00e9 offre au demandeur un temps de r\u00e9flexion suppl\u00e9mentaire destin\u00e9 \u00e0 \u00e9valuer l'opportunit\u00e9 que repr\u00e9sente le d\u00e9p\u00f4t d'une marque internationale. Celui-ci d\u00e9bute \u00e0 la date du d\u00e9p\u00f4t fran\u00e7ais et court pour une dur\u00e9e de 6 mois ; si le d\u00e9p\u00f4t de la marque internationale a lieu durant cette p\u00e9riode, celle-ci sera alors consid\u00e9r\u00e9e comme ayant \u00e9t\u00e9 d\u00e9pos\u00e9e en m\u00eame temps que la marque nationale, et les demandes d\u00e9pos\u00e9es par des tiers dans cet intervalle ne pourront lui \u00eatre oppos\u00e9s.
