The internationalisation of trade and globalisation nowadays and more often than not, implies the need to export abroad, a hypothesis in which more extensive protection is required. The protection granted to European trademarks is particularly interesting in this respect.<\/p>\n<h2>Protection extended to all European Union countries<\/h2>\n<p>The protection granted by the European Union automatically concerns the 27 Member States of the Union, without reaching an excessive price. <a href=\"http:\/\/depot-de-marque.com\/en\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/\">Registering a French trademark with the INPI (French National Institute for Industrial Property)<\/a> is generally charged between 250 and 300 euros; that of a European trademark will only be charged at 900 euros, for effective protection in 27 states, i.e. a market of around 500 million consumers. Except if only a very small number of foreign countries are targeted, it is therefore much more interesting to opt for a European trademark than to register a national trademark in each country concerned. It is therefore a unitary title, registered with a single organisation in return for a single payment. The competent office, EUIPO<a href=\"https:\/\/euipo.europa.eu\/ohimportal\/fr\/home\" data-cke-saved-href=\"https:\/\/euipo.europa.eu\/ohimportal\/fr\/home\" data-cke-saved- target=\"_blank\" rel=\"noopener\"> (European Union Intellectual Property Office),<\/a> centralises the applications and in principle issues the registration within 6 months.<\/p>\n<p>However, the advantage of a unitary title can also backfire on the applicant: all countries, without exception, must accept registration, otherwise the application is automatically rejected. In other words, the trademark must be available in all 27 countries of the Union and not be the subject of any well-founded opposition. In this case, the application can still be transformed into different national applications for the countries concerned, but the operation will give rise to a conversion fee in addition to the national fees required in each country for the registration of a national trademark. On the other hand, the transformation is automatic, which means that the file filed before the EUIPO will be transmitted to the countries concerned without having to make new individual applications.<\/p>\n<p>A thorough search for availability is therefore of paramount importance. There are approximately 10 million registered trademarks in the European Union, which necessarily gives rise to a high number of oppositions when filing a new trademark, in the order of 20%. <a href=\"http:\/\/depot-de-marque.com\/en\/deposit-rates\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/tarifs-depot\" data-cke-saved->To facilitate prior art searches<\/a>In addition, several organizations offer to carry out searches directly online free of charge, which is also offered by the INPI through its \"trademark databases\".<\/p>\n<h2>The priority period following the registration of a national trademark<\/h2>\n<p>The prior filing of a national trademark is not necessary for a Community-wide application, but is often an essential step and greatly facilitates the process of extension abroad. The filing of a national trademark, in the French case, gives a \"right of priority\" when filing a Community or international trademark. In order to benefit from this right of priority, the European trademark must be filed within 6 months following the filing of the national trademark. If the application is accepted, the European trademark will be considered as having been filed on the date of the national trademark application: in other words, it will have priority over applications filed by third parties within this 6-month period.<\/p>\n<p>The priority period thus allows the applicant to assess the commercial potential of his trademark and his products, and then to be able to estimate the opportunity of registering a European trademark.<\/p>","protected":false},"excerpt":{"rendered":"<p>D\u00e9poser une marque europ\u00e9enne Si le d\u00e9p\u00f4t d&rsquo;une marque fran\u00e7aise peut parfois offrir une protection suffisante, l&rsquo;\u00e9largissement \u00e0 une marque europ\u00e9enne s&rsquo;av\u00e8re aujourd&rsquo;hui de plus en plus opportun. La protection accord\u00e9e aux marques europ\u00e9ennes s'av\u00e8re \u00e0 cet \u00e9gard particuli\u00e8rement int\u00e9ressante.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Une protection \u00e9tendue \u00e0 l'ensemble des pays de l'Union Europ\u00e9enne&lt;\/h2&gt;&lt;p&gt;La protection accord\u00e9e par l'Union Europ\u00e9enne concerne automatiquement les 27 \u00c9tats membres de l'Union, sans atteindre pour autant un prix excessif. &lt;a href=\"http:\/\/depot-de-marque.com\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/\"&gt;Le d\u00e9p\u00f4t d'une marque fran\u00e7aise aupr\u00e8s de l'INPI&lt;\/a&gt; est en g\u00e9n\u00e9ral factur\u00e9 entre 250 et 300 euros ; celui d'une marque europ\u00e9enne ne le sera qu'\u00e0 hauteur de 900 euros, pour une protection effective dans 27 Etats, soit un march\u00e9 d'environ 500 millions de consommateurs. Sauf \u00e0 ne viser qu'un nombre tr\u00e8s r\u00e9duit de pays \u00e9trangers, il est donc bien plus int\u00e9ressant d'opter pour une marque europ\u00e9enne que de d\u00e9poser une marque nationale dans chaque pays vis\u00e9. Il s'agit donc d'un titre unitaire, d\u00e9pos\u00e9 aupr\u00e8s d'un seul organisme moyennant un unique paiement. L'office comp\u00e9tent, l'EUIPO&lt;a href=\"https:\/\/euipo.europa.eu\/ohimportal\/fr\/home\" data-cke-saved-href=\"https:\/\/euipo.europa.eu\/ohimportal\/fr\/home\"&gt; (European Union Intellectual Property Office),&lt;\/a&gt; centralise les demandes et d\u00e9livre en principe l'enregistrement dans un d\u00e9lai de 6 mois.&lt;\/p&gt;&lt;p&gt;Toutefois, l'avantage d'un titre unitaire peut \u00e9galement se retourner contre le demandeur : tous les pays, sans aucune exception, doivent accepter l'enregistrement, sans quoi la demande se voit automatiquement rejet\u00e9e. En d'autres termes, la marque d\u00e9pos\u00e9e se doit d'\u00eatre disponible dans les 27 pays de l'Union et ne faire l'objet d'aucune opposition fond\u00e9e. Dans cette hypoth\u00e8se, la demande peut toujours \u00eatre transform\u00e9e en diff\u00e9rentes demandes nationales pour les pays vis\u00e9s, mais l'op\u00e9ration donnera lieu \u00e0 une taxe de transformation en plus des taxes nationales exig\u00e9es dans chaque pays pour l'enregistrement d'une marque nationale. En revanche, la transformation est automatique, ce qui signifie que le dossier d\u00e9pos\u00e9 devant l'EUIPO sera transmis dans les pays concern\u00e9s sans avoir \u00e0 effectuer de nouvelles demandes individuelles.&lt;\/p&gt;&lt;p&gt;Un recherche de disponibilit\u00e9 approfondie rev\u00eat donc une importance capitale. On d\u00e9nombre environ 10 millions de marques enregistr\u00e9es au sein de l'Union Europ\u00e9enne, ce qui donne n\u00e9cessairement lieu \u00e0 un nombre \u00e9lev\u00e9 d'oppositions lors du d\u00e9p\u00f4t d'une nouvelle marque, de l'ordre de 20%. &lt;a href=\"http:\/\/depot-de-marque.com\/tarifs-depot\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/tarifs-depot\"&gt;Pour faciliter les recherches d'ant\u00e9riorit\u00e9s&lt;\/a&gt;, plusieurs organismes proposent d'effectuer gratuitement les recherches directement en ligne, ce que propose \u00e9galement l'INPI par le biais de ses \u00ab bases de donn\u00e9es marques \u00bb.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Le d\u00e9lai de priorit\u00e9 suite \u00e0 l'enregistrement d'une marque nationale&lt;\/h2&gt;&lt;p&gt;Le d\u00e9p\u00f4t pr\u00e9alable d'une marque nationale n'est pas n\u00e9cessaire \u00e0 une demande d'enregistrement \u00e0 l'\u00e9chelle communautaire, mais s'av\u00e8re bien souvent une \u00e9tape essentielle et facilite grandement les d\u00e9marches d'extension vers l'\u00e9tranger. Le d\u00e9p\u00f4t d'une marque nationale, en l'esp\u00e8ce fran\u00e7aise, ouvre en effet un \u00ab droit de priorit\u00e9 \u00bb lors du d\u00e9p\u00f4t d'une marque communautaire ou internationale. Pour b\u00e9n\u00e9ficier de ce droit de priorit\u00e9, la marque europ\u00e9enne doit \u00eatre d\u00e9pos\u00e9e dans un d\u00e9lai de 6 mois suivant le d\u00e9p\u00f4t de la marque nationale.
