{"id":1743,"date":"2016-11-29T17:57:42","date_gmt":"2016-11-29T17:57:42","guid":{"rendered":"http:\/\/depot-de-marque.com\/?page_id=1743"},"modified":"2020-12-03T05:51:03","modified_gmt":"2020-12-03T04:51:03","slug":"inpi-trademark-registration","status":"publish","type":"page","link":"https:\/\/depot-de-marque.com\/en\/guide-marques\/inscription-marque-inpi\/","title":{"rendered":"Registering changes"},"content":{"rendered":"<p><a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2016\/11\/GM_inscriptions.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2016\/11\/GM_inscriptions-300x199.jpg\" alt=\"rebrand\" width=\"300\" height=\"199\" \/><\/a><\/p>\n<h1>Registering changes<\/h1>\n<h2>What is an inscription?<\/h2>\n<p>A registration is the registration with the INPI of an act or modification in connection with an industrial property right.<\/p>\n<h2>What you can enter<\/h2>\n<p>As far as trademarks are concerned, the INPI registers can be registered as follows:<\/p>\n<ul>\n<li>A limitation of wording (remove or specify goods or services, delete one or more classes)<\/li>\n<li>An administrative amendment concerning the holder: change of name, company name, address or legal form<\/li>\n<li>Trademark cancellation (voluntarily terminating a trademark before its expiry date)<\/li>\n<li>An assignment or license A rectification of a clerical error (simple error made during the filing, without consequence on the protection)<\/li>\n<\/ul>\n<h2>3 good reasons to register<\/h2>\n<h3>Third Party Information<\/h3>\n<p>It is very important to inform third parties of any changes to the brand. Otherwise, even if a contract is concluded (for example, an assignment or a licence), these changes are not binding on them. In practice, if, for example, the buyer of a trademark uses it in such a way as to infringe the rights of a third party, it is the seller who can be sued if the assignment entry has not been made.<\/p>\n<h3>Ending a dispute quickly and amicably<\/h3>\n<p>Sometimes, following a trademark application, an applicant may be contacted by an earlier trademark owner who believes that the new application infringes his rights. It is sometimes possible to settle this type of dispute amicably by limiting the wording of the trademark. For example, specifying or deleting the disputed goods may allow the trademark to be registered without being challenged.<\/p>\n<p>Other times, if the trademark is really too close to the earlier trademark, it must be cancelled before the INPI, as a simple declaration of abandonment by the owner often does not satisfy the opponent.<\/p>\n<h3>Information from INPI<\/h3>\n<p>Finally, some registrations are made for purely practical reasons. For example, if the holder changes address, it is preferable to inform the INPI, as the latter will send a renewal reminder to the last known address. However, if you do not watch the expiration date of your trademark, you run the risk of <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/rebrand\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/guide-marques\/renouveler-une-marque\">miss the renewal.<\/a><\/p>\n<h2>The registration procedure<\/h2>\n<h3>Online procedure<\/h3>\n<p>The INPI now offers an online registration service. It is therefore no longer necessary to empty your printer cartridge and wear out your wrist because of the multiple copies of signed registration requests to be sent to the INPI. However, it is necessary to attach, as the case may be, supporting documents without which the application will not be validated.<\/p>\n<h3>Supporting documents to be provided<\/h3>\n<ul>\n<li>For the limitation of wording or cancellation of the mark: no document<\/li>\n<li>For the license: a copy of the license agreement<\/li>\n<li>For the assignment: a copy of the assignment contract<\/li>\n<li>For the modification of the name, company name, address or legal form of the holder: no document<\/li>\n<li>For the rectification of a material error: a document proving the error<\/li>\n<\/ul>\n<h3>The cost of a registration<\/h3>\n<p>The price of a registration depends on when the application is made: prior to the registration of the trademark, registrations are free of charge. After registration, the price is 27\u20ac (November 2016) per registered trademark.<\/p>\n<p>Registrations of changes to the name, business name, address or legal form of the holder are always free of charge, regardless of when they are made, even after registration.<\/p>\n<h2>When will my registration be effective?<\/h2>\n<p>From the date appearing on the form that will be returned to you by the INPI, which will include the number and date of registration. However, it will take between 4 and 6 weeks before the registration is published and made known to third parties. Sinon, m\u00eame si un contrat est conclu (par exemple une cession ou une licence), ces modifications ne leur sont pas opposables. En pratique, si par exemple l\u2019acheteur d\u2019une marque l\u2019utilise de mani\u00e8re \u00e0 porter atteinte aux droits d\u2019un tiers, c\u2019est le vendeur qui peut \u00eatre poursuivi en justice si l\u2019inscription de cession n\u2019a pas \u00e9t\u00e9 faite.&lt;\/p&gt;&lt;h3 class=\"ckeditor\"&gt;Mettre fin \u00e0 un litige rapidement et \u00e0 l\u2019amiable&lt;\/h3&gt;&lt;p&gt;Parfois, suite \u00e0 un d\u00e9p\u00f4t de marque, un d\u00e9posant peut \u00eatre contact\u00e9 par un titulaire de marque ant\u00e9rieure qui estime que le nouveau d\u00e9p\u00f4t porte atteinte \u00e0 ses droits. Il est parfois possible de r\u00e9gler \u00e0 l\u2019amiable ce genre de litige en proc\u00e9dant \u00e0 une limitation du libell\u00e9 de la marque. Ainsi, la pr\u00e9cision ou la suppression des produits litigieux peuvent permettre \u00e0 la marque d\u2019\u00eatre enregistr\u00e9e sans \u00eatre attaqu\u00e9e.&lt;\/p&gt;&lt;p&gt;D\u2019autres fois, si la marque est vraiment trop proche de la marque ant\u00e9rieure, il faut la radier devant l\u2019INPI, une simple d\u00e9claration d\u2019abandon de la part du titulaire ne satisfaisant souvent pas l\u2019adversaire.&lt;\/p&gt;&lt;h3 class=\"ckeditor\"&gt;Information de l\u2019INPI&lt;\/h3&gt;&lt;p&gt;Enfin, on proc\u00e8de \u00e0 certaines inscriptions pour des raisons purement pratiques. Par exemple, si le titulaire change d\u2019adresse, il est pr\u00e9f\u00e9rable d\u2019en informer l\u2019INPI car ce dernier enverra un rappel de renouvellement \u00e0 la derni\u00e8re adresse connue. Or si vous ne surveillez pas l\u2019\u00e9ch\u00e9ance de votre marque, vous risquez de &lt;a href=\"http:\/\/depot-de-marque.com\/guide-marques\/renouveler-une-marque\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/guide-marques\/renouveler-une-marque\"&gt;manquer le renouvellement.&lt;\/a&gt;&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;La proc\u00e9dure d\u2019inscription&lt;\/h2&gt;&lt;h3 class=\"ckeditor\"&gt;Proc\u00e9dure en ligne&lt;\/h3&gt;&lt;p&gt;D\u00e9sormais, l\u2019INPI propose un service en ligne d\u2019inscription. Ce n\u2019est donc plus la peine de vider sa cartouche d\u2019imprimante et d\u2019user son poignet \u00e0 cause des multiples exemplaires de demandes d\u2019inscription \u00e0 envoyer \u00e0 l\u2019INPI sign\u00e9s. Il faut toutefois joindre, selon le cas, des justificatifs sans lesquels la demande ne sera pas valid\u00e9e.&lt;\/p&gt;&lt;h3 class=\"ckeditor\"&gt;Justificatifs \u00e0 fournir&lt;\/h3&gt;&lt;ul&gt;&lt;li&gt;Pour la limitation de libell\u00e9 ou la radiation de la marque : aucun document&lt;\/li&gt;&lt;li&gt;Pour la licence : une copie du contrat de licence&lt;\/li&gt;&lt;li&gt;Pour la cession : une copie du contrat de cession&lt;\/li&gt;&lt;li&gt;Pour la modification de nom, de d\u00e9nomination sociale, d\u2019adresse ou de forme juridique du titulaire : aucun document&lt;\/li&gt;&lt;li&gt;Pour la rectification d\u2019erreur mat\u00e9rielle : un document prouvant l\u2019erreur&lt;\/li&gt;&lt;\/ul&gt;&lt;h3 class=\"ckeditor\"&gt;Le co\u00fbt d\u2019une inscription&lt;\/h3&gt;&lt;p&gt;Le prix d\u2019une inscription d\u00e9pend du moment o\u00f9 la demande est faite : avant l\u2019enregistrement de la marque, les inscriptions sont gratuites. Apr\u00e8s l\u2019enregistrement, le prix est de 27\u20ac (novembre 2016) par marque faisant l\u2019objet de l\u2019inscription.&lt;\/p&gt;&lt;p&gt;Les inscriptions de modification de nom, de d\u00e9nomination sociale, d\u2019adresse ou de forme juridique du titulaire sont toujours gratuites, quel que soit le moment o\u00f9 elles sont faites, m\u00eame apr\u00e8s l\u2019enregistrement.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;A partir de quand mon inscription est-elle effective ?&lt;\/h2&gt;&lt;p&gt;A partir de la date figurant sur le formulaire qui vous sera renvoy\u00e9 par l\u2019INPI, et qui comportera le num\u00e9ro et la date de l\u2019inscription. Il faudra cependant attendre entre 4 et 6 semaines avant que l\u2019inscription ne soit publi\u00e9e, et port\u00e9e \u00e0 la connaissance des tiers.
