Trademark renewal<\/h1>\n

The registration of a trademark is valid for a period of 10 years. At the end of this period, it must be renewed to continue to benefit from protection.<\/p>\n

When and how to renew?<\/h2>\n

A registered trademark is valid for 10 years, but can be renewed indefinitely. If it is not renewed, it will no longer enjoy any protection and the property right will lapse. Each validity period expires 10 years after the date of filing, and a notification from INPI is sent to the holder 6 months before the end of the validity period. Please note: mail is sent to the last registered address, so it's important to remember to notify INPI of any changes.<\/p>\n

Trademark renewal is possible up to 12 months before the expiry date, and no application will be considered before this date. In principle, however, it is not possible to renew a trademark after it has expired. However, an additional period of 6 months has been introduced: the grace period. During this period, all renewals will be subject to a surcharge of 50% of the initial fee.<\/p>\n

Since 2015, the renewal procedure has been greatly simplified, as it can now be carried out directly online.<\/p>\n

Who has to renew?<\/h2>\n

In principle, the owner of the trade mark registered in the National Register of Trademarks<\/a> to proceed with its renewal, but other hypotheses are possible.<\/p>\n

Use of an agent<\/h3>\n

The trademark owner may call upon an professional representative<\/a> to represent him. He will nevertheless be obliged to do so when he is neither established nor domiciled in France or in another Member State of the European Union or the European Economic Area.<\/p>\n

In case of change of ownership<\/h3>\n

Where the person wishing to renew is different from the person who has carried out the registration of the trademark<\/a>The change of ownership must have been recorded in the National Trademark Register, i.e. before or at the same time as the renewal application.<\/p>\n

Trademark modification at renewal<\/h2>\n

No modification of the trademark to alter the sign or extend the protection is possible after its filing, nor is it possible when it is renewed. On the other hand, the proprietor may reduce the list of goods and services at any time. At renewal, this is also possible, whether it is a question of deleting entire classes or only specific goods and\/or services.<\/p>\n

A d\u00e9faut de renouvellement, celle-ci ne b\u00e9n\u00e9ficiera plus d'aucune protection et le droit de propri\u00e9t\u00e9 s\u2019\u00e9teindra. Chaque p\u00e9riode de validit\u00e9 expire 10 ans apr\u00e8s le dernier jour du mois de son d\u00e9p\u00f4t et une notification de l'INPI est envoy\u00e9e au titulaire 6 mois avant le terme de la p\u00e9riode de validit\u00e9. Attention : le courrier est envoy\u00e9 \u00e0 la derni\u00e8re adresse enregistr\u00e9e, il est donc important de penser \u00e0 signifier toute modification \u00e0 l\u2019INPI.<\/p><p>Le renouvellement d'une marque est possible dans les 6 mois avant la date de son \u00e9ch\u00e9ance et aucune demande ne sera prise en compte avant cette date. En revanche il n'est en principe pas possible de renouveler une marque apr\u00e8s son \u00e9ch\u00e9ance. Toutefois un d\u00e9lai suppl\u00e9mentaire de 6 mois a \u00e9t\u00e9 mis en place : le d\u00e9lai de gr\u00e2ce. Durant cette p\u00e9riode, tout renouvellement sera surtax\u00e9 \u00e0 hauteur de 125\u20ac.<\/p><p>La proc\u00e9dure de renouvellement a \u00e9t\u00e9 grandement facilit\u00e9e puisqu'il est possible, depuis 2015, de l'effectuer directement en ligne. Une autre possibilit\u00e9 consiste \u00e0 remplir le formulaire \"d\u00e9claration de renouvellement\" en 5 exemplaires et de l'envoyer \u00e0 l'INPI.<\/p><h2 class=\"ckeditor\">Qui doit proc\u00e9der au renouvellement ?<\/h2><p>Il revient en principe au propri\u00e9taire de la marque inscrit au <a href=\"http:\/\/droit-finances.commentcamarche.net\/faq\/23975-registre-national-des-marques-definition\" data-cke-saved-href=\"http:\/\/droit-finances.commentcamarche.net\/faq\/23975-registre-national-des-marques-definition\">Registre national des marques<\/a> de proc\u00e9der \u00e0 son renouvellement, mais d'autres hypoth\u00e8ses sont envisageables.<\/p><h3 class=\"ckeditor\">Recourir \u00e0 un mandataire<\/h3><p>Le propri\u00e9taire de la marque peut faire appel \u00e0 un <a href=\"http:\/\/depot-de-marque.com\/conseil-propriete-industrielle\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/conseil-propriete-industrielle\">mandataire professionnel<\/a> charg\u00e9 de le repr\u00e9senter. Il y sera n\u00e9anmoins oblig\u00e9 lorsqu'il n'est ni \u00e9tabli, ni domicili\u00e9 en France ou dans un autre Etat membre de l'Union Europ\u00e9enne ou de l'Espace \u00e9conomique europ\u00e9en.<\/p><h3 class=\"ckeditor\">En cas de changement de propri\u00e9taire<\/h3><p>Lorsque la personne souhaitant proc\u00e9der au renouvellement est diff\u00e9rente de celle ayant effectu\u00e9 <a href=\"http:\/\/depot-de-marque.com\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\">le d\u00e9p\u00f4t de la marque<\/a>, le changement de propri\u00e9taire doit imp\u00e9rativement avoir \u00e9t\u00e9 consign\u00e9 au Registre national des marques. L'enregistrement doit donc avoir \u00e9t\u00e9 effectu\u00e9 avant ou en m\u00eame temps que la demande de renouvellement.<\/p><h3 class=\"ckeditor\">En cas de cession partielle<\/h3><p>Dans cette hypoth\u00e8se, chaque copropri\u00e9taire de la marque doit la renouveler pour les seuls produits et\/ou services dont il est propri\u00e9taire.<\/p><h2 class=\"ckeditor\">Modification de la marque lors du renouvellement<\/h2><p>Aucune modification de la marque visant \u00e0 modifier le signe ou \u00e9largir la protection n'est possible apr\u00e8s son d\u00e9p\u00f4t, et il en est de m\u00eame lors de son renouvellement. En revanche, le titulaire peut r\u00e9duire la liste des produits et services \u00e0 tout moment. Lors du renouvellement cette d\u00e9marche est donc \u00e9galement possible, qu'il s'agisse de supprimer des classes enti\u00e8res ou seulement des produits et\/ou services pr\u00e9cis.<\/p><p>Pour \u00e9largir la port\u00e9e de la protection accord\u00e9e \u00e0 la marque, modifier son nom ou son apparence, un nouveau d\u00e9p\u00f4t est n\u00e9cessaire mais peut \u00eatre associ\u00e9 \u00e0 un renouvellement anticip\u00e9 de la premi\u00e8re marque. Les deux marques seront par la suite associ\u00e9es : celles-ci b\u00e9n\u00e9ficieront d'une m\u00eame date d'\u00e9ch\u00e9ance (celle du nouveau d\u00e9p\u00f4t) et les classes identiques aux deux marques ne seront compt\u00e9es qu'une seule fois pour d\u00e9terminer le montant de la redevance du prochain renouvellement.<\/p>__TVE_SHORTCODE_RAW___<\/div><\/div>
