Or: I've been using the name for several years, and I've never had any problems, so why register?<\/p>\n<p><strong>Registering a trademark offers several advantages<\/strong>. After reading the following reasons, you too will want to register your trademark!<\/p>\n<h2>Register your brand to be the first<\/h2>\n<p>Almost everywhere in the world, whoever registers first gets the rights to the name.<\/p>\n<p><strong> In France, long-standing use of a trademark does not confer any rights.<\/strong> Consequently, if you use a trademark without having registered it, a third party can register it in your place. They could then prevent you from continuing to use it. Worse: in extreme cases, you could even be considered an infringer, and owe damages to the third party! In this case, good faith is irrelevant! But there is a simple way to protect yourself from such a situation: registering a trademark.<\/p>\n<p>Note that certain other prior rights (such as a company name or domain name) can also be asserted against a third party using the same name after you. However, these rights are difficult to defend (you need to prove that they have been used and since when), and do not allow for as many actions (see below).<\/p>\n<p>In all cases, i<strong>n the event of a dispute, the first thing to look for is the date of the oldest rights.<\/strong>. It is therefore very important, when using a trademark, to register it first, at least as a precautionary measure, to prevent subsequent third parties from preventing you from using the name in the future.<\/p>\n<p>Registering your trademark therefore secures the use of your name.<\/p>\n<h2>Register your brand to be the only one to use it<\/h2>\n<p>Trademark registration confers a monopoly on the use of a name and\/or logo in connection with specific products and\/or services.<\/p>\n<p><em>For example: the Tesla trademark is registered for cars. No other person can use it to designate cars (or any other vehicle). There is therefore a monopoly on the name \"Tesla\" for these products.<\/em><\/p>\n<p><strong>Trademarks are industrial property rights enforceable against third parties.<\/strong> It is therefore possible to prevent an identical or similar trademark from being registered using the <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/trademark-opposition\/\">opposition proceedings<\/a>. Illicit use can also be stopped by means of other actions: nullity, infringement or unfair competition.<\/p>\n<p>But beware: a monopoly must be maintained. The INPI is not going to refuse a trademark because there is an identical earlier trademark. It's up to the trademark owner to check that no one else is registering\/using a similar trademark. Therefore, p<span style=\"color: var(--tcb-skin-color-5); font-weight: var(--g-regular-weight, normal);\">o make sure you're the only one left to exploit the name in question, <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/surveillance-veille-marque\/\">you need to keep a close eye on your brand.<\/a><\/span><\/p>\n<h2>Register your trademark to protect and defend yourself effectively<\/h2>\n<p><span style=\"color: var(--tcb-skin-color-5); font-weight: var(--g-regular-weight, normal);\"><strong>Trademark registration is a deterrent that should not be overlooked.<\/strong> In fact, once a trademark has been registered, it appears on the <a href=\"https:\/\/data.inpi.fr\/recherche_avancee\/marques\" target=\"_blank\" rel=\"noopener\">INPI register<\/a> A third party wishing to register this name will see that it has already been taken. Most of the time, this encourages the third party to choose another name.\u00a0<\/span><\/p>\n<p><strong>In addition, a trademark gives its owner the ability to defend himself effectively.<\/strong> (which simple use does not). Trademarks can be used in administrative proceedings before the INPI (opposition \/ invalidity) or other bodies (e.g. to obtain the transfer of a domain name). Above all, however, a trademark can be used to bring infringement proceedings. This enables the trademark owner to claim damages (sometimes substantial).<\/p>\n<p>If you haven't registered a trademark, you can't sue for infringement. You may, however, be able to bring an action for unfair competition - but this is more difficult to do.<\/p>\n<h2>Other advantages of trademark registration<\/h2>\n<p>There are many other reasons for registering a trademark:<\/p>\n<p>1\/ <strong>The brand is a financial asset<\/strong> Trademarks can be licensed (for royalties) or sold. In other words, a brand can make you money!<\/p>\n<p>2\/ <strong>For online sellers<\/strong> The brand enables you to benefit from commercial advantages. For example, the <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/brand-registry-amazon-brand-registry\/\">Amazon Trademarks Register<\/a> (<a href=\"https:\/\/brandservices.amazon.com\/\" target=\"_blank\" rel=\"noopener\">Amazon Brand Registry<\/a>) allows sellers to have a monopoly on the registered name, and thus prohibit competitors from posting ads with that name. Most platforms have developed a similar system.<\/p>\n<p>3\/<strong> Trademarks are a lasting right<\/strong> If renewed and exploited, a trademark can last for centuries! It is valid for 10 years from the date of registration, and is renewable every 10 years thereafter. Mis \u00e0 part quelques rares pays comme les Etats-Unis ou le Canada, le fait d\u2019utiliser une marque depuis longtemps ne conf\u00e8re en principe pas de droit de propri\u00e9t\u00e9 industrielle sur ce nom. D\u00e8s lors, si vous utilisez une marque sans l\u2019avoir d\u00e9pos\u00e9e, un tiers peut la d\u00e9poser avant vous et vous emp\u00eacher par la suite de poursuivre son exploitation. Pire : vous pourriez m\u00eame, dans des cas extr\u00eames, \u00eatre consid\u00e9r\u00e9 comme contrefacteur, et devoir des dommages et int\u00e9r\u00eats \u00e0 ce tiers. Un comble, pensez-vous ? Dans un sens, oui. Mais il existe un moyen simple pour se pr\u00e9munir d\u2019une telle situation : le d\u00e9p\u00f4t de marque.&lt;\/p&gt;\n&lt;p&gt;Notez quand m\u00eame que certains autres droits ant\u00e9rieurs que vous pourriez d\u00e9tenir et utiliser, comme une d\u00e9nomination sociale ou un nom de domaine, peuvent faire obstacle \u00e0 un d\u00e9p\u00f4t post\u00e9rieur par un tiers, mais ne sont pas aussi simples \u00e0 mettre en oeuvre qu\u2019un droit de marque.&lt;\/p&gt;\n&lt;p&gt;Dans tous les cas, il faut garder \u00e0 l\u2019esprit qu\u2019en cas de conflit, la premi\u00e8re chose que l\u2019on recherche est la date des droits les plus anciens. Il est donc tr\u00e8s important, en cas d\u2019usage d\u2019une marque, de faire pr\u00e9c\u00e9der cet usage d\u2019un enregistrement, au moins \u00e0 titre conservatoire, afin d\u2019\u00e9viter que des tiers post\u00e9rieurs ne viennent vous emp\u00eacher d\u2019utiliser le nom par la suite.&lt;\/p&gt;\n&lt;h2 class=\"ckeditor\"&gt;Pour \u00eatre le seul \u00e0 l\u2019utiliser&lt;\/h2&gt;\n&lt;p&gt;Le d\u00e9p\u00f4t de marque conf\u00e8re un monopole d\u2019exploitation sur un nom et\/ou un logo, en lien avec des produits et\/ou des services sp\u00e9cifiques. Il s\u2019agit d\u2019un droit de propri\u00e9t\u00e9 industrielle qui est opposable aux tiers : il est donc possible d\u2019emp\u00eacher une marque identique ou proche d\u2019\u00eatre enregistr\u00e9e gr\u00e2ce \u00e0 la proc\u00e9dure d\u2019opposition. On peut \u00e9galement faire cesser un usage illicite au moyen de l\u2019action en contrefa\u00e7on ou en concurrence d\u00e9loyale.&lt;\/p&gt;\n&lt;p&gt;Attention toutefois : un monopole s\u2019entretient. Pour \u00eatre certain de rester seul \u00e0 exploiter le nom en question, il convient de surveiller sa marque correctement.&lt;\/p&gt;\n&lt;h2 class=\"ckeditor\"&gt;Pour se prot\u00e9ger des tiers&lt;\/h2&gt;\n&lt;p&gt;Lorsque vous \u00eates le premier \u00e0 avoir d\u00e9pos\u00e9 une marque, aucun tiers ne peut vous emp\u00eacher de l\u2019utiliser, tant que vous-m\u00eame en faites un usage s\u00e9rieux, c\u2019est \u00e0 dire un usage suffisamment fr\u00e9quent et\/ou volumineux pour&lt;a href=\"http:\/\/depot-de-marque.com\/guide-marques\/les-etapes-respecter-pour-enregistrer-une-marque\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/guide-marques\/les-etapes-respecter-pour-enregistrer-une-marque\"&gt; valider votre enregistrement de marque&lt;\/a&gt;. En effet, si la marque n\u2019est pas utilis\u00e9e pendant plus de 5 ans, tout tiers int\u00e9ress\u00e9 peut en demander la d\u00e9ch\u00e9ance devant le juge.&lt;\/p&gt;\n&lt;h2 class=\"ckeditor\"&gt;Pour se d\u00e9fendre facilement&lt;\/h2&gt;\n&lt;p&gt;Le droit de marque conf\u00e8re \u00e0 son titulaire la possibilit\u00e9 d\u2019engager deux actions sp\u00e9cifiques, que ne peuvent pas utiliser les personnes qui font usage d\u2019un nom sans avoir proc\u00e9d\u00e9 au d\u00e9p\u00f4t de la marque :&lt;\/p&gt;\n&lt;ul&gt;\n&lt;li&gt;La proc\u00e9dure d\u2019opposition : c\u2019est une proc\u00e9dure administrative que l\u2019on engage devant un office de marque (en France, devant l\u2019INPI). Elle permet de s\u2019opposer \u00e0 l\u2019enregistrement d\u2019une marque identique ou proche de la sienne, dans son domaine d\u2019activit\u00e9 ou un domaine proche (en claire, il faut que les marques se ressemblent, mais les produits et services vis\u00e9s par les marques en cause aussi). Cette proc\u00e9dure \u00e9vite de passer devant le juge et est donc beaucoup plus rapide qu\u2019un proc\u00e8s et infiniment plus \u00e9conomique (\u00e0 peine plus de 300 \u20ac de taxes pour l\u2019engager). Elle est toutefois encadr\u00e9e par des d\u00e9lais tr\u00e8s stricts (seulement 2 mois \u00e0 compter de la publication de la marque \u00e0 laquelle on souhaite s\u2019opposer). Si ce d\u00e9lai expire avant de former opposition, il n\u2019est pas possible de se rattraper : il faut alors lancer une action en annulation devant le juge, beaucoup plus longue et co\u00fbteuse.&lt;\/li&gt;\n&lt;li&gt;L\u2019action en contrefa\u00e7on : cette action peut \u00eatre engag\u00e9e par n\u2019importe quel &lt;a href=\"http:\/\/depot-de-marque.com\/conseil-propriete-industrielle\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/conseil-propriete-industrielle\"&gt;titulaire de droit de propri\u00e9t\u00e9 intellectuelle&lt;\/a&gt;.
