If co-ownership of the mark is possible, it will most often be held by a single entity (an association, an interest group, a cooperative, a trade union, etc.) which will authorize its members to use the mark. <\/strong><\/p>\n<p><strong>Indeed, the collective mark is primarily used to enable consumers to identify the origin of a product or service. <\/strong>geographical area, method of manufacture or any other characteristic<strong> commune <\/strong>products or services of the members of the incumbent entity. Thus, an association of Breton producers has opted for the following sign, which allows a buyer to quickly identify products created in Brittany :<\/p>\n<p><a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/logo_peb_100.gif\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/logo_peb_100.gif\" alt=\"collective trademark produced in brittany\" width=\"100\" height=\"100\" \/><\/a><\/p>\n<p>However, in order to have the right to use this symbol on its own products, an authorization from the entity holding the <strong>collective trademark<\/strong> is necessary. Indeed, the latter must ensure that its members comply with certain standards, which must be mentioned in the rules of use of the trademark (Art. L. 715-1 CPI).<\/p>\n<p>The <strong>collective marks<\/strong> are thus most often used to promote products that are characteristic of a given region. But other uses can also be envisaged: for example, SMEs brought together in an association could register a collective mark which would enable them to jointly market their products. It is to give a better visibility to their products that the National Union of Independent Brewers (SNBI) has recently registered the collective trademark \"Independent Brewer\":<\/p>\n<p><a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/logo_bi_cadre_rvb_noir_hd-cp.jpeg\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/logo_bi_cadre_rvb_noir_hd-cp-150x150.jpeg\" alt=\"collective mark independent brewer\" width=\"150\" height=\"150\" \/><\/a><\/p>\n<p>Furthermore, there is nothing to prevent the inclusion of a <strong>collective trademark<\/strong> and an individual brand on the same product, allowing to gain visibility, while distinguishing its product from those of its competitors. Moreover, a French collective mark can be superimposed on a Community collective mark.<\/p>\n<p>While collective marks are little known, there are a large number of them, which meet different requirements depending on the regime to which they are subject.<\/p>\n<h2><strong>The different types of collective marks<\/strong><\/h2>\n<h3><strong>French collective trademarks<\/strong><\/h3>\n<p><strong>The Intellectual Property Code distinguishes between two types of collective marks: the so-called \"simple\" collective mark and the certification mark, which is subject to a stricter regime. <\/strong><\/p>\n<ul>\n<li><strong>The simple collective mark: a mark of belonging<\/strong><\/li>\n<\/ul>\n<p>The simple collective trademark is quite similar to \"classic\" trademarks, as its only function is to guarantee a given origin or membership in a group of professionals. The general interest is therefore not sought: the simple collective mark does not aim to guarantee a particular quality of goods or services. It must, however, be distinctive.<\/p>\n<p>However, unlike traditional brands, the <strong>collective trademark<\/strong> does not confer a monopoly on its holder, since it is supposed to allow its members to use it. The establishment of rules of use will therefore be necessary and will make it possible to avoid entering into trademark licensing contracts with each user. Indeed, as soon as a person meets the objective conditions laid down by the regulations, he automatically has a right to use the mark. If the exploitation of the collective mark does not comply with the conditions laid down in the Regulation, the user is liable to disciplinary or even judicial sanctions.<\/p>\n<p>Finally, the regulations for use must be sent to the INPI, if possible at the time of filing or at the latest at the time of publication of the trademark. The latter will in fact be registered in the national trademark register.<\/p>\n<ul>\n<li><strong>The collective certification mark: a genuine quality label<\/strong><\/li>\n<\/ul>\n<p>Unlike the simple collective mark, the <strong>guarantee mark<\/strong> pursues an aim of general interest and is therefore subject to a stricter legal regime.<\/p>\n<p>Thus, the deposit will be made by a legal entity capable of issuing a certification, which must be neither a manufacturer, importer, nor seller of the products or services concerned (Art. L. 715-2 CPI). This condition of independence is a guarantee of consumer protection.<\/p>\n<p>In addition, the rules of use must specify the characteristics of the designated product or service, and in particular \"its nature, properties or qualities\" (Art. L.715-1 CPI). This is a genuine approved specification, which provides for a system of control by the registrant. The regulations must be filed with the trademark application.<\/p>\n<p>The <strong>collective certification mark<\/strong> has enhanced protection against tampering. Moreover, it cannot be assigned. This non-transferability is explained by the fact that the trademark is definitively linked to its owner, who is the only one who can exercise control over it. Finally, if the trademark ceases to be used and is not renewed, there is a 10-year waiting period on the term concerned, prohibiting any new filing by a third party (Art. L.715-2 6\u00b0 CPI).<\/p>\n<h3><strong>The European collective mark<\/strong><\/h3>\n<p><strong>At the European level, no distinction is made between simple collective and certification marks.<\/strong> The <strong>European collective mark<\/strong> therefore has a single legal regime. This trademark provides protection throughout the European Union.<\/p>\n<p>An application for an EU collective trademark may only be filed by associations of manufacturers, producers, service providers or traders, as well as legal persons under public law.<\/p>\n<p>The advantage of the EU collective mark is that it allows the registration of signs or indications which may serve to designate the geographical origin of the goods or services, unlike an individual EU mark. However, the collective mark will not allow its proprietor to prohibit a third party from using such signs or geographical indications in trade, where such use is in accordance with honest practices in industrial or commercial matters.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>The applicant for a collective mark must submit regulations for use within two months of the filing date.<\/strong> <strong>In particular, it must specify the persons authorized to use the mark, the conditions of membership of the association owning the mark, and the conditions of use of the mark, including sanctions.<\/strong><\/p>\n<h1><strong>Conclusion: practical interests of the collective mark<\/strong><\/h1>\n<p>If the <strong>simple collective mark<\/strong> does not enjoy a legal advantage in comparison with the classic individual trademark, we have seen that it can be exploited in practice either to indicate membership or for purposes of identification or collective promotion. This is the case when a group of small professionals (for example, small producers) files a collective mark with the aim of appearing as a larger economic entity. The same is true when independent professionals come together to register a trademark and conduct an advertising campaign around that trademark. They thus hope to benefit from the spin-offs of this campaign, while bearing only part of the costs.<\/p>\n<p>The use of the <strong>collective trademark<\/strong> may also go beyond a simple commercial argument. Thus, the National Council of the Order of Pharmacists has registered as a collective mark the emblem consisting of a Greek cross with equal branches and green in colour. That mark pursues the objective of guaranteeing the quality of the goods concerned.<\/p>\n<p>Consequently, the collective mark, whatever its form, offers a competitive advantage to its users, since consumers see it as a guarantee of quality. Si la cotitularit\u00e9 de la marque est possible, celle-ci sera le plus souvent d\u00e9tenue par une seule entit\u00e9 (une association, un groupement d\u2019int\u00e9r\u00eats, une coop\u00e9rative, un syndicat de commer\u00e7ants\u2026) qui autorisera ses membres \u00e0 utiliser la marque. &lt;\/strong&gt;&lt;\/p&gt;&lt;p&gt;&lt;strong&gt;En effet, la marque collective est avant tout utilis\u00e9e pour permettre aux consommateurs d\u2019identifier l\u2019origine &lt;\/strong&gt;g\u00e9ographique, le mode de fabrication ou toute autre caract\u00e9ristique&lt;strong&gt; commune &lt;\/strong&gt;des produits ou des services des membres de l\u2019entit\u00e9 titulaire. Ainsi, une association de producteurs bretons a opt\u00e9 pour le signe suivant, qui permet \u00e0 un acheteur d\u2019identifier rapidement des produits cr\u00e9\u00e9s en Bretagne :&lt;\/p&gt;&lt;p&gt;&lt;a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/logo_peb_100.gif\"&gt;&lt;img class=\"aligncenter size-full wp-image-2737\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/logo_peb_100.gif\" alt=\"marque collective produit en bretagne\" width=\"100\" height=\"100\" \/&gt;&lt;\/a&gt;&lt;\/p&gt;&lt;p&gt;Mais pour avoir le droit de faire figurer ce sigle sur ses propres produits, une autorisation de l\u2019entit\u00e9 titulaire de la &lt;strong&gt;marque collective&lt;\/strong&gt; est n\u00e9cessaire. Celle-ci doit en effet veiller \u00e0 ce que ses membres respectent certaines normes, qui doivent \u00eatre mentionn\u00e9es dans le r\u00e8glement d\u2019usage de la marque (Art. L. 715-1 CPI).&lt;\/p&gt;&lt;p&gt;Les &lt;strong&gt;marques collectives&lt;\/strong&gt; sont ainsi le plus souvent utilis\u00e9es pour promouvoir des produits caract\u00e9ristiques d\u2019une r\u00e9gion donn\u00e9e. Mais d\u2019autres utilisations peuvent \u00eatre envisag\u00e9es&nbsp;: ainsi, des PME r\u00e9unies en association pourraient enregistrer une marque collective qui leur permettrait de commercialiser conjointement leurs produits. C\u2019est pour donner une meilleure visibilit\u00e9 \u00e0 leurs produits, que le Syndicat National des Brasseurs Ind\u00e9pendants (SNBI) a r\u00e9cemment d\u00e9pos\u00e9 la marque collective \u00ab&nbsp;Brasseur ind\u00e9pendant&nbsp;\u00bb :&lt;\/p&gt;&lt;p&gt;&lt;a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/logo_bi_cadre_rvb_noir_hd-cp.jpeg\"&gt;&lt;img class=\"aligncenter size-thumbnail wp-image-2738\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2018\/06\/logo_bi_cadre_rvb_noir_hd-cp-150x150.jpeg\" alt=\"marque collective brasseur independant\" width=\"150\" height=\"150\" \/&gt;&lt;\/a&gt;&lt;\/p&gt;&lt;p&gt;Par ailleurs, rien n\u2019emp\u00eache de faire figurer une &lt;strong&gt;marque collective&lt;\/strong&gt; et une marque individuelle sur un m\u00eame produit, permettant de gagner en visibilit\u00e9, tout en distinguant son produit de ceux des concurrents. De plus, une marque collective fran\u00e7aise peut tout \u00e0 fait se superposer \u00e0 une marque collective communautaire.&lt;\/p&gt;&lt;p&gt;Si les marques collectives sont peu connues, il en existe un nombre important, qui r\u00e9pondent \u00e0 diff\u00e9rentes conditions selon le r\u00e9gime auquel elles sont soumises.&lt;\/p&gt;&lt;h2&gt;&lt;strong&gt;Les diff\u00e9rents types de marques collectives&lt;\/strong&gt;&lt;\/h2&gt;&lt;h3&gt;&lt;strong&gt;Les marques collectives fran\u00e7aises&lt;\/strong&gt;&lt;\/h3&gt;&lt;p&gt;&lt;strong&gt;Le Code de la propri\u00e9t\u00e9 intellectuelle distingue deux types de marques collectives&nbsp;: la marque collective dite \u00ab&nbsp;simple&nbsp;\u00bb et la marque de certification, soumise \u00e0 un r\u00e9gime plus strict. &lt;\/strong&gt;&lt;\/p&gt;&lt;ul&gt;&lt;li&gt;&lt;strong&gt;La marque collective simple&nbsp;: une marque d\u2019appartenance&lt;\/strong&gt;&lt;\/li&gt;&lt;\/ul&gt;&lt;p&gt;La marque collective simple est assez proche des marques \u00ab&nbsp;classiques&nbsp;\u00bb, car sa seule fonction est de garantir une origine donn\u00e9e ou une appartenance \u00e0 un groupement de professionnels. L'int\u00e9r\u00eat g\u00e9n\u00e9ral n'est donc pas recherch\u00e9&nbsp;: la marque collective simple n\u2019a pas pour objectif de garantir une qualit\u00e9 particuli\u00e8re des produits ou services. Elle doit cependant \u00eatre distinctive.&lt;\/p&gt;&lt;p&gt;Toutefois, contrairement aux marques classiques, la &lt;strong&gt;marque collective&lt;\/strong&gt; ne conf\u00e8re pas un monopole \u00e0 son titulaire, puisqu\u2019il est cens\u00e9 permettre \u00e0 ses membres de l\u2019utiliser. L'\u00e9tablissement d'un r\u00e8glement d'usage sera donc n\u00e9cessaire et permettra d\u2019\u00e9viter de conclure des contrats de licence de marque avec chaque utilisateur. En effet, d\u00e8s qu\u2019une personne remplit les conditions objectives pos\u00e9es par le r\u00e8glement, elle dispose automatiquement d\u2019un droit d\u2019exploitation de la marque. Si l\u2019exploitation de la marque collective ne respecte pas les conditions pos\u00e9es par le r\u00e8glement, l\u2019utilisateur encourt des sanctions disciplinaires voire judiciaires.&lt;\/p&gt;&lt;p&gt;Enfin, le r\u00e8glement d\u2019usage devra \u00eatre envoy\u00e9 \u00e0 l\u2019INPI, si possible lors du d\u00e9p\u00f4t ou au plus tard au moment de la publication de la marque. Celui-ci sera en effet inscrit au registre national des marques.&lt;\/p&gt;&lt;ul&gt;&lt;li&gt;&lt;strong&gt;La marque collective de certification&nbsp;: un v\u00e9ritable label de qualit\u00e9&lt;\/strong&gt;&lt;\/li&gt;&lt;\/ul&gt;&lt;p&gt;Contrairement \u00e0 la marque collective simple, la &lt;strong&gt;marque de certification&lt;\/strong&gt; poursuit un but d\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral et est donc soumise \u00e0 un r\u00e9gime juridique plus strict.&lt;\/p&gt;&lt;p&gt;Ainsi, le d\u00e9p\u00f4t sera fait par une personne morale capable de d\u00e9livrer une certification, qui ne doit \u00eatre ni fabricant, ni importateur, ni vendeur des produits ou services vis\u00e9s (Art. L. 715-2 CPI). Cette condition d\u2019ind\u00e9pendance est le gage de la protection du consommateur.&lt;\/p&gt;&lt;p&gt;De plus, le r\u00e8glement d\u2019usage devra pr\u00e9ciser les caract\u00e8res du produit ou du service d\u00e9sign\u00e9, et notamment \u00ab sa nature, ses propri\u00e9t\u00e9s ou ses qualit\u00e9s \u00bb (Art. L.715-1 CPI). Il s\u2019agit ici d\u2019un v\u00e9ritable cahier des charges homologu\u00e9, et qui pr\u00e9voit un syst\u00e8me de contr\u00f4le par le titulaire. Le r\u00e8glement doit \u00eatre d\u00e9pos\u00e9 avec la demande de d\u00e9p\u00f4t de la marque.&lt;\/p&gt;&lt;p&gt;La &lt;strong&gt;marque collective de certification&lt;\/strong&gt; dispose d\u2019une protection renforc\u00e9e contre les atteintes. De plus, elle ne peut pas \u00eatre c\u00e9d\u00e9e. Cette intransmissibilit\u00e9 s'explique par le fait que la marque est d\u00e9finitivement li\u00e9e \u00e0 son titulaire, qui est le seul \u00e0 pouvoir exercer un contr\u00f4le dessus. Enfin, si la marque cesse d\u2019\u00eatre utilis\u00e9e et n\u2019est pas renouvel\u00e9e, il existe un d\u00e9lai de carence de 10 ans sur le terme concern\u00e9, interdisant tout nouveau d\u00e9p\u00f4t par un tiers (Art. L.715-2 6\u00b0 CPI).&lt;\/p&gt;&lt;h3&gt;&lt;strong&gt;La marque collective europ\u00e9enne&lt;\/strong&gt;&lt;\/h3&gt;&lt;p&gt;&lt;strong&gt;Au niveau europ\u00e9en, aucune distinction n\u2019est faite entre marques collectives simple et de certification.&lt;\/strong&gt; La &lt;strong&gt;marque collective europ\u00e9enne&lt;\/strong&gt; dispose donc d\u2019un r\u00e9gime juridique unique. Cette marque assure une protection \u00e0 l\u2019\u00e9chelle de l\u2019Union Europ\u00e9enne.&lt;\/p&gt;&lt;p&gt;Une demande de marque collective de l\u2019UE ne peut \u00eatre d\u00e9pos\u00e9e que par des associations de fabricants, de producteurs, de prestataires de services ou de commer\u00e7ants, ainsi que par des personnes morales de droit public.&lt;\/p&gt;&lt;p&gt;L\u2019avantage de la marque collective de l\u2019UE est qu\u2019elle permet d\u2019enregistrer des signes ou indications pouvant servir \u00e0 d\u00e9signer la provenance g\u00e9ographique des produits ou services, contrairement \u00e0 une marque individuelle de l\u2019UE.
