In France<\/h2>\n

\"Deadline<\/a><\/p>\n

In France, the entire procedure between filing and registration of the trademark takes about 6 months. However, the registration of the trademark always reacts to the day of filing, so the trademark is protected from that day on.<\/p>\n

From the day of filing, the trademark is published within 3 to 6 weeks (the deadlines vary according to the workload of the INPI).<\/p>\n

The opposition period begins with the publication of the trademark, which serves to inform third parties of your application: it allows the owners of earlier trademarks to oppose, before the INPI, to the registration of your trademark<\/a>because it is identical or too close to theirs, in the same or a related industry. If an opposition is filed, the procedure can be extended by a good 6 months, or even longer if the procedure is suspended by mutual agreement of the parties, in order to allow time for negotiations. If, on the contrary, no opposition is filed, then the registration of the trademark will continue normally.<\/p>\n

Approximately 6 months after filing, if there is no opposition, the INPI issues the certificate of registration of the trademark, and sends it to the owner or his Industrial Property Counsel, who will forward it to him.<\/p>\n

In the European Union<\/h2>\n

In Europe, the development of the registration process<\/a> is the same as in France. However, the deadlines change slightly.<\/p>\n

The publication of a European filing is normally made within 8 to 11 weeks after filing. This time limit can be halved thanks to a fast-track procedure called \"Fast Track\". This procedure can only be used if the goods and services referred to in the mark have been chosen from a list proposed by the Office. If, on the contrary, as is often preferable, the wording is \"tailor-made\", then the classical procedure is to be preferred.<\/p>\n

The opposition period is longer than in France, since it lasts 3 months. Moreover, when an opposition is filed, the office grants the parties a so-called \"cooling off\" period, which is in fact a time that allows the parties to negotiate an amicable agreement. It is possible to extend this \"cooling off\" period for a further 22 months. A European opposition can therefore be very long!<\/p>\n

Once the opposition period has passed, the mark will be registered. EUIPO <\/a>takes a total of 4 to 6 months to register a European trade mark, depending on the procedure used and if it is not disrupted along the way.<\/p>","protected":false},"excerpt":{"rendered":"

Si une opposition est form\u00e9e, la proc\u00e9dure peut \u00eatre rallong\u00e9e de 6 bons mois, voire encore plus si la proc\u00e9dure est suspendue d\u2019un commun accord des parties, afin de se laisser le temps de n\u00e9gocier. Si au contraire aucune opposition n\u2019est form\u00e9e, alors l\u2019enregistrement de la marque se poursuit normalement.<\/p><p>Environ 6 mois apr\u00e8s le d\u00e9p\u00f4t, s\u2019il n\u2019y a pas d\u2019opposition, l\u2019INPI \u00e9dite le certificat d\u2019enregistrement de la marque, et l\u2019envoie au titulaire ou \u00e0 son Conseil en Propri\u00e9t\u00e9 Industrielle, qui lui fera suivre.<\/p><h2 class=\"ckeditor\">En Union Europ\u00e9enne<\/h2><p class=\"ckeditor\" style=\"text-align: center;\"><a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2016\/08\/delais-procedure-europe.jpg\"><img class=\"aligncenter size-full wp-image-1659\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2016\/08\/delais-procedure-europe.jpg\" alt=\"delai pour enregistrer une marque en Europe - EUIPO\" width=\"400\" height=\"1000\" \/><\/a><\/p><p>En Europe, le d\u00e9roulement <a href=\"http:\/\/depot-de-marque.com\/guide-marques\/les-etapes-respecter-pour-enregistrer-une-marque\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/guide-marques\/les-etapes-respecter-pour-enregistrer-une-marque\">de la proc\u00e9dure d\u2019enregistrement<\/a> est le m\u00eame qu\u2019en France. Les d\u00e9lais changent toutefois l\u00e9g\u00e8rement.<\/p><p>La publication d\u2019un d\u00e9p\u00f4t europ\u00e9en intervient en principe sous 8 \u00e0 11 semaines apr\u00e8s le d\u00e9p\u00f4t. Ce d\u00e9lai peut \u00eatre r\u00e9duit de moiti\u00e9 gr\u00e2ce \u00e0 une proc\u00e9dure acc\u00e9l\u00e9r\u00e9e appel\u00e9e \u201cFast Track\u201d. Cette proc\u00e9dure ne peut \u00eatre utilis\u00e9e que si les produits et services vis\u00e9s dans la marque ont \u00e9t\u00e9 choisis parmi une liste propos\u00e9e par l\u2019office. Si au contraire, comme c\u2019est souvent pr\u00e9f\u00e9rable, le libell\u00e9 est r\u00e9dig\u00e9 \u201csur-mesure\u201d, alors la proc\u00e9dure classique est \u00e0 privil\u00e9gier.<\/p><p>Le d\u00e9lai d\u2019opposition est plus long qu\u2019en France, puisqu\u2019il dure 3 mois. Par ailleurs, lorsqu\u2019une opposition est form\u00e9e, l\u2019office accorde aux parties une p\u00e9riode dite de \u201ccooling off\u201d, qui est en fait un temps qui permet aux parties de n\u00e9gocier un accord amiable. Il est possible de prolonger cette p\u00e9riode de \u201ccooling off\u201d pour 22 mois suppl\u00e9mentaires. Une opposition europ\u00e9enne peut donc \u00eatre tr\u00e8s longue !<\/p><p>Une fois le d\u00e9lai d\u2019opposition pass\u00e9, la marque sera enregistr\u00e9e. <a href=\"https:\/\/euipo.europa.eu\/ohimportal\/fr\/home\" data-cke-saved-href=\"https:\/\/euipo.europa.eu\/ohimportal\/fr\/home\">L\u2019EUIPO <\/a>met en tout entre 4 et 6 mois pour enregistrer une marque europ\u00e9enne, selon la proc\u00e9dure employ\u00e9e et si cette derni\u00e8re n\u2019est pas perturb\u00e9e en cours de route.<\/p>__TVE_SHORTCODE_RAW___<\/div><\/div>
