{"id":1650,"date":"2016-08-24T16:26:00","date_gmt":"2016-08-24T16:26:00","guid":{"rendered":"http:\/\/depot-de-marque.com\/?page_id=1650"},"modified":"2022-09-12T11:45:07","modified_gmt":"2022-09-12T10:45:07","slug":"trademark-registration","status":"publish","type":"page","link":"https:\/\/depot-de-marque.com\/en\/guide-marques\/le-depot-de-marque\/","title":{"rendered":"Trademark registration"},"content":{"rendered":"<p><a href=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2017\/05\/GM_depot-de-marque.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/depot-de-marque.com\/wp-content\/uploads\/2017\/05\/GM_depot-de-marque-300x199.jpg\" alt=\"online trademark registration\" width=\"300\" height=\"199\" \/><\/a><\/p>\n<h1>Trademark registration<\/h1>\n<p>Updated: 12\/09\/2022<\/p>\n<p>Trademark applications are made exclusively online, directly on the offices' websites: a French trademark is filed on the <a href=\"https:\/\/www.inpi.fr\/\" target=\"_blank\" rel=\"noopener\">INPI website<\/a> and we go to the <a href=\"https:\/\/euipo.europa.eu\/\" target=\"_blank\" rel=\"noopener\">EUIPO website<\/a> to register a European trademark.<\/p>\n<h2>Taxes<\/h2>\n<p>To date (September 2022), the INPI fees are 190 \u20ac for 1 class and 40 \u20ac per additional class. The French trademark covers all DOM-TOM, except for French Polynesia, for which a surcharge of 60 \u20ac is required.<\/p>\n<p>The EUIPO fees (for filing a European Union trademark) are 850 \u20ac for 1 class, 900 \u20ac for 2 classes and 150 \u20ac for each additional class.<\/p>\n<p>Thus, for a registration in 3 classes, it is necessary to count 270 \u20ac of taxes at the INPI and 1050 \u20ac of taxes for a European trademark.<\/p>\n<h2>Holder<\/h2>\n<p>The owner of a trademark can be a natural person or a legal entity (an association, a company, a public institution). As the micro-enterprise does not have a legal personality, the trademark will be held by the micro-entrepreneur, in his personal name.<\/p>\n<p>The French trademark can also be registered in the name and on behalf of a company in the process of being formed, if it is soon to be created. In this case, it is necessary to regularize thereafter with the INPI by a registration indicating that the company was indeed created, or on the contrary that it was never created.<\/p>\n<h2>Agent<\/h2>\n<p>The applicant may be represented by an agent in this process, in particular by an attorney <a href=\"http:\/\/depot-de-marque.com\/en\/industrial-property-consulting\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/conseil-propriete-industrielle\" data-cke-saved->professional such as an Industrial Property Attorney<\/a>. The latter masters all the stages of filing, but also the preparatory phases to ensure the distinctiveness and availability of his trademark. It is recommended that you entrust your trademark registration project to him, in order to secure your rights as much as possible over the long term.<\/p>\n<h2>Sign<\/h2>\n<p>If the brand has a logo (see our article \"<a href=\"http:\/\/depot-de-marque.com\/en\/to-register-a-logo-or-not\/\">to register a logo or not?<\/a>If you want to use a logo (e.g., a logo that is \"small\"), it must respect a certain size, weight and file type. In any case, prefer a good resolution to a tiny logo, which will not be optimized for publication.<\/p>\n<p>Note that many applicants try to protect several variants of the same trademark in the same filing, by submitting a logo in several colors for example, or a word trademark with several slogans... However, the INPI protects exactly what you communicate to it. It is therefore advisable to send the logo as you use it, with the right colors, the right resolution, the right verbal elements if necessary...<\/p>\n<p>It should be noted that you will be obliged, thereafter, to use the trademark in this form in order to validate its registration. Therefore, if a trademark has been registered in several forms in the same application, all these forms must be used together, which is never the case. The rule is therefore: one logo = one application. One name = one application.<\/p>\n<h2>Products and services<\/h2>\n<p>At the time of filing, Offices always offer wording \"help\" in the sense that they provide pre-prepared lists of goods and services, which are best avoided. For more information, see <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/classes-of-goods-and-services\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/guide-marques\/les-classes-de-produits-et-services\" data-cke-saved->on classes of goods and services.<\/a><\/p>\n<p>It is therefore necessary to write \"by hand\" one's own wording, in free text, in order to retranscribe one's activity in one's trademark and, above all, to protect oneself well. This requires a precise drafting technique and a good knowledge of the uses of the offices.<\/p>\n<p>It is also important to choose the right classes of products and\/or services. Indeed, if you make a mistake and some products or services actually belong to another class that you did not target in the filing, the INPI will refuse to add it. You will have to proceed with a new filing, which will entail new fees (INPI does not refund the fees if the filing is not good).<\/p>\n<h2>Number<\/h2>\n<p>Once the application has been filed, the Office shall transmit a proof of filing and assign a number to the mark. In France and in the European Union, the filing number and the registration number are identical (this has not always been the case, and is still not the case in a number of countries around the world).<\/p>\n<h2>Review<\/h2>\n<p>The Office in question then proceeds to examine the mark and checks its admissibility. If the mark is not sufficiently distinctive or if the wording is not sufficiently precise or is not properly classified, the Office sends a notification of irregularity to the proprietor.<\/p>\n<p>Note that the INPI and the<a href=\"https:\/\/euipo.europa.eu\" target=\"_blank\" rel=\"noopener\">EUIPO<\/a> do not check whether the brand is available or not. This is why so many identical or very similar trademarks coexist on the registers. It is up to the owner to act to defend his rights, which happens in almost 1 out of 4 cases. To avoid such problems, we strongly recommend that you carry out a prior art search beforehand.<\/p>\n<h2>Publication and registration<\/h2>\n<p>Once the objections have been raised, the trademark is published and then registered a few months later, after granting third parties with earlier rights a period of opposition.<\/p>\n<p>In general, the whole procedure takes about 5 to 6 months in France, and between 4 and 6 months in the European Union. The protection of the trademark is always retroactive to the day of filing.<\/p>\n<p>After publication of the trademark, it is common for the owner to receive a document in the mail from a company with a very \"official\" sounding name, such as \"european trademark organization\". This company asks for the payment of a relatively high fee for the publication of the trademark on its registers. Les taxes de l\u2019EUIPO (pour le d\u00e9p\u00f4t d\u2019une marque de l\u2019Union Europ\u00e9enne) sont de 850 \u20ac pour 1 classe, 900 \u20ac pour 2 classes et 150 \u20ac par classe suppl\u00e9mentaire.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Titulaire&lt;\/h2&gt;&lt;p&gt;Le titulaire d\u2019une marque peut \u00eatre une personne physique ou une personne morale (une association ou une soci\u00e9t\u00e9). La marque peut \u00e9galement \u00eatre d\u00e9pos\u00e9e au nom et pour le compte d\u2019une soci\u00e9t\u00e9 en cours de formation, si celle-ci est bient\u00f4t cr\u00e9\u00e9e. Dans ce cas, il faut r\u00e9gulariser par la suite aupr\u00e8s de l\u2019INPI par une inscription lui indiquant que la soci\u00e9t\u00e9 a bien \u00e9t\u00e9 cr\u00e9\u00e9e, ou qu\u2019au contraire elle ne l\u2019a jamais \u00e9t\u00e9.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Mandataire&lt;\/h2&gt;&lt;p&gt;Le d\u00e9posant peut se faire repr\u00e9senter par un mandataire dans cette d\u00e9marche, en particulier par un mandataire &lt;a href=\"http:\/\/depot-de-marque.com\/conseil-propriete-industrielle\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/conseil-propriete-industrielle\"&gt;professionnel tel qu\u2019un Conseil en Propri\u00e9t\u00e9 Industrielle&lt;\/a&gt;. Ce dernier ma\u00eetrise toutes les \u00e9tapes du d\u00e9p\u00f4t, mais \u00e9galement les phases pr\u00e9paratoires permettant de s\u2019assurer de la distinctivit\u00e9 et de la disponibilit\u00e9 de sa marque. Il est recommand\u00e9 de lui confier son projet de d\u00e9p\u00f4t de marque, afin de s\u00e9curiser au maximum ses droits sur le long terme.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Signe&lt;\/h2&gt;&lt;p&gt;Si la marque comporte un logo (voir notre article \u201cd\u00e9poser un logo ou pas?\u201d), il faut que ce dernier respecte une certaine taille, un certain poids et un certain type de fichier. Dans tous les cas, pr\u00e9f\u00e9rez une bonne r\u00e9solution \u00e0 un logo minuscule, dont le rendu \u00e0 la publication ne sera pas optimal. Or, l\u2019INPI prot\u00e8ge exactement ce que vous lui communiquez. Il convient donc de lui transmettre le logo tel que vous l\u2019utilisez, avec les bonnes couleurs, la bonne r\u00e9solution, les bons \u00e9l\u00e9ments verbaux le cas \u00e9ch\u00e9ant\u2026&lt;\/p&gt;&lt;p&gt;A noter que beaucoup de d\u00e9posants essaient de prot\u00e9ger plusieurs variantes de la m\u00eame marque dans le m\u00eame d\u00e9p\u00f4t, en soumettant un logo en plusieurs couleurs par exemple, ou une marque verbale avec plusieurs slogans\u2026 L\u00e0 encore, l\u2019INPI prot\u00e8ge la marque sous la forme exacte que vous avez mentionn\u00e9e dans le d\u00e9p\u00f4t, et vous serez oblig\u00e9, par la suite, d\u2019utiliser la marque sous cette forme afin de valider son enregistrement. D\u00e8s lors, si une marque a \u00e9t\u00e9 d\u00e9pos\u00e9e sous plusieurs formes dans le m\u00eame d\u00e9p\u00f4t, toutes ces formes devront \u00eatre utilis\u00e9es ensemble, ce qui n\u2019est jamais le cas. La r\u00e8gle est donc : un logo, un d\u00e9p\u00f4t. Un nom, un d\u00e9p\u00f4t.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Produits et services&lt;\/h2&gt;&lt;p&gt;Au moment du d\u00e9p\u00f4t, les offices proposent toujours une \u00ab aide \u00bb au libell\u00e9, en ce sens qu\u2019ils fournissent des listes de produits et services pr\u00e9-r\u00e9dig\u00e9es, qu\u2019il est pr\u00e9f\u00e9rable de ne pas utiliser. En savoir plus &lt;a href=\"http:\/\/depot-de-marque.com\/guide-marques\/les-classes-de-produits-et-services\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/guide-marques\/les-classes-de-produits-et-services\"&gt;sur les classes de produits et services.&lt;\/a&gt;&lt;\/p&gt;&lt;p&gt;Il faut donc r\u00e9diger \u00ab \u00e0 la main \u00bb son propre libell\u00e9, en texte libre, afin de bien retranscrire son activit\u00e9 dans sa marque et surtout bien se prot\u00e9ger. Cela demande une technique r\u00e9dactionnelle pr\u00e9cise et une bonne connaissance des usages des offices.&lt;\/p&gt;&lt;p&gt;Il faut \u00e9galement bien choisir ses classes de produits et\/ou services. En effet, si vous vous trompez et que certains produits ou services appartiennent en r\u00e9alit\u00e9 \u00e0 une autre classe que vous n\u2019avez pas vis\u00e9e dans le d\u00e9p\u00f4t, l\u2019INPI refusera de la rajouter. Il faudra proc\u00e9der \u00e0 un nouveau d\u00e9p\u00f4t, ce qui entra\u00eenera les m\u00eames frais (l\u2019INPI ne rembourse pas les taxes si le d\u00e9p\u00f4t n\u2019est pas bon).&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Num\u00e9ro&lt;\/h2&gt;&lt;p&gt;Une fois le d\u00e9p\u00f4t effectu\u00e9, l\u2019office transmet un justificatif de d\u00e9p\u00f4t et attribue un num\u00e9ro \u00e0 la marque. En France et en Union Europ\u00e9enne, le num\u00e9ro de d\u00e9p\u00f4t et le num\u00e9ro d\u2019enregistrement sont identiques (\u00e7a n\u2019a pas toujours \u00e9t\u00e9 le cas, et ce n\u2019est toujours pas le cas dans un certain nombre de pays du monde).&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Examen&lt;\/h2&gt;&lt;p&gt;L\u2019office en question proc\u00e8de ensuite \u00e0 l\u2019examen de la marque et v\u00e9rifie sa recevabilit\u00e9. Si la marque n\u2019est pas assez distinctive ou si le libell\u00e9 n\u2019est pas suffisamment pr\u00e9cis ou n\u2019est pas bien classifi\u00e9, l\u2019office envoie une notification d\u2019irr\u00e9gularit\u00e9 au titulaire.&lt;\/p&gt;&lt;p&gt;Notez que l\u2019INPI et l\u2019&lt;a href=\"https:\/\/euipo.europa.eu\"&gt;EUIPO&lt;\/a&gt; ne v\u00e9rifient pas si la marque est disponible ou non. C\u2019est pour cela que tant de marques identiques ou tr\u00e8s similaires coexistent sur les registres. C\u2019est au titulaire d\u2019agir pour d\u00e9fendre ses droits, ce qui arrive dans pr\u00e8s d\u20191 cas sur 4. Pour \u00e9viter de tels d\u00e9boires, nous vous recommandons fortement de proc\u00e9der en amont \u00e0 une recherche d\u2019ant\u00e9riorit\u00e9s.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Publication et enregistrement&lt;\/h2&gt;&lt;p&gt;Une fois les objections lev\u00e9es, la marque est publi\u00e9e, puis est enregistr\u00e9e quelques mois plus tard, apr\u00e8s avoir allou\u00e9 aux tiers titulaires de droits ant\u00e9rieurs une p\u00e9riode d\u2019opposition.&lt;\/p&gt;&lt;p&gt;En g\u00e9n\u00e9ral, la proc\u00e9dure compl\u00e8te dure environ 6 mois en France, et entre 4 et 6 mois en Union Europ\u00e9enne. La protection de la marque r\u00e9troagit toujours au jour du d\u00e9p\u00f4t.&lt;\/p&gt;&lt;p&gt;Apr\u00e8s la publication de la marque, il est courant que le titulaire re\u00e7oive par la poste un document \u00e9manant d\u2019une soci\u00e9t\u00e9 dont le nom sonne tr\u00e8s \u201cofficiel\u201d, tel que \u201ceuropean trademark organization\u201d. Cette soci\u00e9t\u00e9 demande le paiement d\u2019une somme relativement \u00e9lev\u00e9e pour la publication de la marque sur ses registres.
