When it comes to guaranteeing industrial property titles, a reliable and neutral service should therefore be offered, which is what the INPI does. However, its monopoly situation leads the French public establishment to charge prices to which the public is obliged to submit, without the possibility of competition. The INPI is thus in a monopoly situation and offers the prices it wishes, although they remain regulated and controlled by the State.<\/p>\n<h2>How much does it cost to file with the INPI?<\/h2>\n<p>The INPI offers many services, which some consider too expensive for small project leaders. The latter sometimes find themselves faced with a difficult choice: pay to register their trademark, or save the money, at the risk of encountering intellectual property problems later on.<\/p>\n<p>Here are the main INPI filing fees, which have changed in mid-December 2019, as a result of <a href=\"http:\/\/depot-de-marque.com\/en\/pi-news\/new-inpi-rates\/\">the entry into force of the PACTE law<\/a> :<\/p>\n<ul>\n<li>Registering a trademark online is charged 190 euros for 1 class, compared to 210 euros for 1 to 3 classes before the reform. Note that it is 250 euros if it is done in paper format, justified by the additional steps required by the INPI to process the file.<\/li>\n<li>For each additional class, the Institute charges 40 euros (compared to 42 euros before the reform).<\/li>\n<\/ul>\n<p>Remember that trademark protection lasts 10 years, so the annual investment is relatively low. Although some people prefer to limit their expenses as much as possible when they start their business in order to concentrate on their core business, it is and always remains preferable to register their trademark before starting to use it, or at the beginning of its use. These searches make it possible to ensure the availability of a trademark in its sector of activity, and therefore its freedom of use.<\/p>\n<p>As for the cost of research:<\/p>\n<ul>\n<li>Identical searches do not require any particular investment: they are carried out on databases that are freely accessible and make it possible to detect any prior trademarks that are strictly identical to one's project.<\/li>\n<li>Similarity searches are subject to a fee, and cost 50 \u20ac for 1 to 3 classes. They consist of a listing of relevant earlier trademarks that are visually or phonetically close to his project. <em>For example, if the proposed trademark is GRINGO, similarity searches will identify earlier trademarks such as GRINGUETTE, GRINGA, BINGO, etc...<\/em><\/li>\n<\/ul>\n<p>Not all the marks found by the INPI during prior art searches are relevant, but in order to know the potential danger they represent, it is necessary to apply an <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/availability-brand-search-danteriorites\/\">precise method of analysis.<\/a> As the INPI does not offer an analysis service for these trademarks, the applicant is left to his own devices. In almost all cases, the applicant is not able to draw the right conclusions from such a listing, which is then useless to him. In the meantime, there is no fee to be paid to the INPI for maintaining the trademark in force. As of today (March 2020), <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/price-of-a-brand-depot\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/guide-marques\/comment-renouveler-sa-marque\">the cost of renewing a brand<\/a> The cost of a French class is \u20ac290 for 1 class, and \u20ac40 for each additional class (before the reform, the cost was \u20ac250 for 3 classes).<\/p>\n<h3>Publication or registration scams<\/h3>\n<p>Beware, unscrupulous companies systematically send letters to applicants asking them to pay a large sum for the publication of their trademark on their registers. They usually use names that sound \"official\", such as \"European Intellectual Property Institute\". Some are tempted to pay these bills. Of course, this is a common scam, which is also encountered when setting up a business. The fact that the registration of the trademark does not expire does not lead the INPI to make any reimbursement.<\/p>\n<p>This is why it is preferable, before filing, to ensure that your trademark is registrable and available.<\/p>\n<h2>Registering your trademark directly or seeking legal advice<\/h2>\n<p>Intellectual property is a particularly broad and complex subject requiring in-depth knowledge. Pour autant, sa situation de monopole am\u00e8ne l\u2019\u00e9tablissement public fran\u00e7ais \u00e0 pratiquer des prix auxquels est oblig\u00e9 de se soumettre le public, sans possibilit\u00e9 de mise en concurrence. L\u2019INPI est ainsi en situation de monopole est propose de ce fait les prix qu\u2019il souhaite, bien qu\u2019ils restent encadr\u00e9s et contr\u00f4l\u00e9s par l\u2019Etat.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Quel co\u00fbt pour le d\u00e9p\u00f4t aupr\u00e8s de l\u2019INPI ?&lt;\/h2&gt;&lt;p&gt;L\u2019INPI propose de nombreux services, que certains jugent trop on\u00e9reux pour les petits porteurs de projets. Ces derniers se retrouvent ainsi parfois face \u00e0 un choix corn\u00e9lien : payer pour d\u00e9poser leur marque, ou \u00e9conomiser l\u2019argent, au risque de rencontrer des probl\u00e8mes de propri\u00e9t\u00e9 intellectuelle par la suite.&lt;\/p&gt;&lt;p&gt;Voici les principaux tarifs de d\u00e9p\u00f4t \u00e0 l\u2019INPI, qui ont chang\u00e9 mi-d\u00e9cembre 2019, suite \u00e0 &lt;a href=\"http:\/\/depot-de-marque.com\/actualite-pi\/nouveaux-tarifs-inpi\"&gt;l'entr\u00e9e en vigueur de la loi PACTE&lt;\/a&gt; :&lt;\/p&gt;&lt;ul&gt;&lt;li&gt;Le d\u00e9p\u00f4t d\u2019une marque en ligne est factur\u00e9 190 euros pour 1 classe, contre 210 euros pour 1 \u00e0 3 classes avant la r\u00e9forme. Notez qu'il est \u00e0 250 euros s\u2019il est r\u00e9alis\u00e9 au format papier, justifi\u00e9 par les d\u00e9marches suppl\u00e9mentaires n\u00e9cessaires \u00e0 l\u2019INPI pour le traitement du dossier.&lt;\/li&gt;&lt;li&gt;Pour chaque classe suppl\u00e9mentaire, l\u2019Institut facture 40 euros (contre 42 euros avant la r\u00e9forme).&lt;\/li&gt;&lt;\/ul&gt;&lt;p&gt;Rappelons que la protection de la marque dure 10 ans, l\u2019investissement annuel est donc relativement faible. Bien qu\u2019\u00e0 la cr\u00e9ation de leur entreprise, certaines personnes pr\u00e9f\u00e8rent limiter au maximum leurs d\u00e9penses pour se concentrer sur leur c\u0153ur de m\u00e9tier, il est et reste toujours pr\u00e9f\u00e9rable de d\u00e9poser sa marque avant de commencer \u00e0 l\u2019utiliser, ou au d\u00e9but de son usage. Ces recherches permettent de s\u2019assurer de la disponibilit\u00e9 d\u2019une marque dans son secteur d\u2019activit\u00e9, et donc de sa libert\u00e9 d\u2019exploitation.&lt;\/p&gt;&lt;p&gt;En ce qui concerne le co\u00fbt des recherches :&lt;\/p&gt;&lt;ul&gt;&lt;li&gt;Les recherches \u00e0 l\u2019identique ne n\u00e9cessitent pas d'investissement particulier : elles se font sur les bases de donn\u00e9es qui sont librement accessibles et permettent de d\u00e9celer d\u2019\u00e9ventuelles marques ant\u00e9rieures strictement identiques \u00e0 son projet.&lt;\/li&gt;&lt;li&gt;Les recherches de similitudes sont payantes, et co\u00fbtent 50 \u20ac pour 1 \u00e0 3 classes. Elles consistent en un listing de marques ant\u00e9rieures pertinentes qui sont proches visuellement ou phon\u00e9tiquement de son projet. &lt;em&gt;Par exemple, si le projet de marque est GRINGO, les recherches de similitudes permettront de d\u00e9celer des marques ant\u00e9rieures telles que GRINGUETTE, GRINGA, BINGO, etc\u2026.&lt;\/em&gt;&lt;\/li&gt;&lt;\/ul&gt;&lt;p&gt;Toutes les marques relev\u00e9es par l\u2019INPI lors des recherches d\u2019ant\u00e9riorit\u00e9s ne sont pas pertinentes, mais pour conna\u00eetre le danger potentiel qu\u2019elles repr\u00e9sentent, il faut appliquer une &lt;a href=\"http:\/\/depot-de-marque.com\/guide-marques\/disponibilite-marque-recherche-danteriorites\/\"&gt;m\u00e9thode d\u2019analyse pr\u00e9cise.&lt;\/a&gt; L\u2019INPI ne proposant pas de service d\u2019analyse de ces marques, le d\u00e9posant est livr\u00e9 \u00e0 lui-m\u00eame. Dans la quasi totalit\u00e9 des cas, il n\u2019est pas en mesure de tirer les bonnes conclusions d\u2019un tel listing, qui lui est alors inutile. Elles prennent en g\u00e9n\u00e9ral des noms qui sonnent \u201cofficiel\u201d, comme \u201cinstitut europ\u00e9en de la propri\u00e9t\u00e9 intellectuelle\u201d. Certains sont tent\u00e9s de payer ces factures. Il ne faut bien s\u00fbr pas y donner suite, il s\u2019agit d\u2019une arnaque courante, que l\u2019on rencontre \u00e9galement lors de la cr\u00e9ation de son entreprise. Le fait que l\u2019enregistrement de la marque n\u2019arrive pas \u00e0 son terme n\u2019am\u00e8ne pas l\u2019INPI \u00e0 proc\u00e9der \u00e0 un quelconque remboursement.&lt;\/p&gt;&lt;p&gt;C\u2019est pourquoi il est pr\u00e9f\u00e9rable, avant le d\u00e9p\u00f4t, de s\u2019assurer que sa marque est enregistrable et qu\u2019elle est disponible.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;D\u00e9poser directement sa marque ou faire appel \u00e0 un conseil&lt;\/h2&gt;&lt;p&gt;La propri\u00e9t\u00e9 intellectuelle est un sujet particuli\u00e8rement vaste et complexe, n\u00e9cessitant des connaissances approfondies. Il est important pour les d\u00e9posants d\u2019\u00eatre conscients du danger existant. La solidit\u00e9 du projet peut ainsi se voir chamboul\u00e9e en cas de mauvais d\u00e9p\u00f4t, de contestation de la part d\u2019un concurrent aux moyens financiers importants, ou encore du manque d\u2019information sur ce domaine.
