Is there a better time than another to do so? We answer your questions!<\/p>\n<h2>Deposit as soon as possible<\/h2>\n<p>As we have already said, in France, the first one to file is usually the one who is right. This encourages people to register their trademark as soon as possible, at least before any exploitation begins. Indeed, if you start communicating on a name that sounds pretty to the ears of an indelicate competitor, the latter may decide to register the trademark before you do. In this case, it will be difficult for you to get it back, especially if you have no prior rights to oppose. However, if you have an opposable domain name or company name, you will have to initiate proceedings (opposition or cancellation). There is therefore a significant legal risk (will you succeed in recovering the trademark?). On top of that, there is the time and money spent on proceedings, which can be significant.<\/p>\n<p>In short: as soon as you get the idea, de-po-sez!<\/p>\n<h2>The best time to register your trademark<\/h2>\n<p>Ideally, a trademark should be registered 4 months before starting to use it. Why should you do that? Because, as we explain in our <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/procedural-deadlines\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/guide-marques\/delais-de-procedure\">article on trademark application procedure<\/a>There is an opposition period open to third parties to prevent the registration of your trademark. This period expires approximately 3 months after filing. Once this period has elapsed without any problems, it is at least reasonable to assume that the major players in your profession, who in principle actively monitor their trademarks, have not found anything wrong with your trademark and have not wished to oppose it. This is reassuring, as the chances of being subsequently attacked are statistically lower.<\/p>\n<p>Note that you are free to use your trademark before the expiration of this period, but if a third party files an opposition and the INPI agrees, then you may have to change your name, and thus lose the investments (time, finances...) that you have made on the first trademark.<\/p>\n<p>The need to file 3 months before the start of operations can be avoided by proceeding as follows <a href=\"http:\/\/depot-de-marque.com\/en\/brand-guide\/availability-brand-search-danteriorites\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/guide-marques\/disponibilite-et-recherches-danteriorites-dune-marque\">a thorough background check <\/a>Thanks to it, the legal environment of the trademark being considered for registration is known, and the potential dangers are perfectly clear. If no real obstacles have been identified during the search, one can then file without fear, and start using one's trademark serenely, without having to wait for the opposition period to expire. The in-depth search nevertheless requires specialized analytical skills, which an Industrial Property Attorney puts at your service in order to ensure you a protective and safe trademark.<\/p>\n<h2>Strategies around the filing date<\/h2>\n<h3>Postpone the date of publication of the mark<\/h3>\n<p>Such a practice would make it possible to inform third parties of a filing only at a late stage, while retaining protection from the filing date. This type of practice exists in particular in the field of designs.<\/p>\n<p>However, there is unfortunately no way to delay the publication of a trademark. Moreover, the date of publication is always uncertain, depending on the workload of the INPI. If currently (June 2016) the INPI publishes applications very quickly (in about 3 weeks), this delay can be up to 6 weeks.<\/p>\n<h3>Accelerate the publication of the trademark<\/h3>\n<p>Conversely, some may be tempted to speed up the publication of their trademark in order to move more quickly to the opposition procedure, and thus to the registration of their trademark. However, in France, it is not possible to speed up the publication procedure either.<\/p>\n<p>However, in the European Union, the EUIPO has set up a procedure for European trademarks, known as the \"European Trademark Office\". <a href=\"https:\/\/euipo.europa.eu\/ohimportal\/fr\/fast-track-conditions\" data-cke-saved-href=\"https:\/\/euipo.europa.eu\/ohimportal\/fr\/fast-track-conditions\" data-cke-saved- target=\"_blank\" rel=\"noopener\">of \"fast track\",<\/a> which reduces the procedure time from 6 to 4 months. The trademark is published very quickly (in less than a month), because the owner has chosen a wording (list of goods and services) which contains only expressions pre-approved by the EUIPO. The examination of the application is therefore facilitated for the Office, which can more easily speed up the procedure.<\/p>\n<h3>Deposit at the last moment<\/h3>\n<p>Some companies operating in highly competitive sectors need to protect their brand as soon as possible in case there is a leak to a competitor. But at the same time, they prefer to file as late as possible in order to postpone the date of publication of the trademark as much as possible, so that their competitors only become aware of it at the last moment. It is indeed common for companies in the same market to \"inspire\" each other, or to thwart the communication on a new opposing product by releasing a similar product at the same time. It is important in these businesses to stay ahead of the competition. From the point of view of trademark registration, the publication date is then calculated and the trademark is filed so that it is published at the same time as the product in question is placed on the market.<\/p>\n<p>However, beware of this kind of tactic, which can backfire if important information is leaked as a result of the carelessness of an employee or supplier\/partner.<\/p>","protected":false},"excerpt":{"rendered":"<p>Quand faut-il d\u00e9poser sa marque ? En effet, si on commence \u00e0 communiquer sur un nom qui sonne joliment aux oreilles d\u2019un concurrent ind\u00e9licat, celui-ci peut d\u00e9cider de d\u00e9poser la marque avant vous. Dans ce cas, il vous sera compliqu\u00e9 de la r\u00e9cup\u00e9rer, surtout si vous n'avez aucun droit ant\u00e9rieur \u00e0 opposer. Si toutefois vous disposez d'un nom de domaine ou d'une d\u00e9nomination sociale opposable, vous devrez engager des proc\u00e9dures (opposition ou annulation). Il y a donc un al\u00e9a juridique important (parviendrez-vous \u00e0 r\u00e9cup\u00e9rer la marque ?). A cela s\u2019ajoutent le temps et l\u2019argent d\u00e9pens\u00e9s en proc\u00e9dure, qui peuvent \u00eatre importants.&lt;\/p&gt;&lt;p&gt;En bref : d\u00e8s que vous avez l\u2019id\u00e9e, d\u00e9-po-sez !&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Le meilleur moment pour d\u00e9poser sa marque&lt;\/h2&gt;&lt;p&gt;Id\u00e9alement, il faudrait d\u00e9poser sa marque 4 mois avant de commencer \u00e0 l\u2019exploiter. Pourquoi ? Parce que, ainsi que nous l\u2019expliquons dans notre &lt;a href=\"http:\/\/depot-de-marque.com\/guide-marques\/delais-de-procedure\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/guide-marques\/delais-de-procedure\"&gt;article sur la proc\u00e9dure de d\u00e9p\u00f4t de marque&lt;\/a&gt;, il existe un d\u00e9lai d\u2019opposition ouvert aux tiers pour emp\u00eacher l\u2019enregistrement de votre marque. Ce d\u00e9lai expire environ 3 mois apr\u00e8s le d\u00e9p\u00f4t. Une fois ce d\u00e9lai pass\u00e9 sans encombre, on peut \u00e0 tout le moins raisonnablement penser que les gros acteurs de votre m\u00e9tier, qui surveillent en principe activement leurs marques, n\u2019ont rien trouv\u00e9 \u00e0 redire au sujet de la v\u00f4tre et n\u2019ont pas souhait\u00e9 s\u2019y opposer. Cela est rassurant, les chances d\u2019\u00eatre attaqu\u00e9 par la suite sont statistiquement plus faibles.&lt;\/p&gt;&lt;p&gt;Notez que vous \u00eates libre d\u2019utiliser votre marque avant l\u2019expiration de ce d\u00e9lai, mais si un tiers forme opposition et que l\u2019INPI lui donne raison, alors vous pourriez \u00eatre amen\u00e9 \u00e0 changer de nom, et donc \u00e0 perdre les investissements (temps, finances\u2026) que vous aurez r\u00e9alis\u00e9s sur la premi\u00e8re marque.&lt;\/p&gt;&lt;p&gt;On peut \u00e9chapper \u00e0 la n\u00e9cessit\u00e9 de d\u00e9poser 3 mois avant le d\u00e9but d'exploitation en proc\u00e9dant &lt;a href=\"http:\/\/depot-de-marque.com\/guide-marques\/disponibilite-marque-recherche-danteriorites\/\" data-cke-saved-href=\"http:\/\/depot-de-marque.com\/guide-marques\/disponibilite-et-recherches-danteriorites-dune-marque\"&gt;\u00e0 une recherche d\u2019ant\u00e9riorit\u00e9s approfondie &lt;\/a&gt;: gr\u00e2ce \u00e0 elle, l\u2019environnement juridique de la marque que l\u2019on envisage de d\u00e9poser est connu, et on sait parfaitement o\u00f9 sont les dangers potentiels. Si aucun v\u00e9ritable obstacle n\u2019a \u00e9t\u00e9 relev\u00e9 au cours de la recherche, on peut alors d\u00e9poser sans crainte, et commencer l\u2019exploitation de sa marque sereinement, sans avoir \u00e0 attendre \u00e0 attendre l\u2019expiration du d\u00e9lai d\u2019opposition. La recherche approfondie n\u00e9cessite n\u00e9anmoins des comp\u00e9tences d\u2019analyse pointues, qu\u2019un Conseil en Propri\u00e9t\u00e9 Industrielle met \u00e0 votre service afin de vous assurer une marque protectrice et sans danger.&lt;\/p&gt;&lt;h2 class=\"ckeditor\"&gt;Les strat\u00e9gies autour de la date de d\u00e9p\u00f4t&lt;\/h2&gt;&lt;h3 class=\"ckeditor\"&gt;Repousser la date de publication de la marque&lt;\/h3&gt;&lt;p&gt;Une telle pratique permettrait de n\u2019informer les tiers d\u2019un d\u00e9p\u00f4t que tardivement, tout en conservant une protection depuis la date de d\u00e9p\u00f4t. Ce type de pratique existe notamment en mati\u00e8re de dessins et mod\u00e8les.&lt;\/p&gt;&lt;p&gt;Toutefois, il n\u2019existe malheureusement aucun moyen de repousser la publication d\u2019une marque. Par ailleurs, la date de publication est toujours incertaine, en fonction de la charge de travail de l\u2019INPI. Si actuellement (juin 2016) l\u2019INPI publie tr\u00e8s rapidement les d\u00e9p\u00f4ts (en 3 semaines environ), ce d\u00e9lai peut aller jusqu\u2019\u00e0 6 semaines.&lt;\/p&gt;&lt;h3 class=\"ckeditor\"&gt;Acc\u00e9l\u00e9rer la publication de la marque&lt;\/h3&gt;&lt;p&gt;A l\u2019inverse, certains pourraient \u00eatre tent\u00e9s d\u2019acc\u00e9ler la publication de leur marque afin d\u2019aller plus rapidement vers la proc\u00e9dure d\u2019opposition, et donc vers l\u2019enregistrement de leur marque. Il n\u2019est cependant pas possible non plus, en France, d\u2019acc\u00e9l\u00e9rer la proc\u00e9dure de publication.&lt;\/p&gt;&lt;p&gt;Toutefois, en Union Europ\u00e9enne, l\u2019EUIPO a mis en place, pour les marques europ\u00e9ennes, une proc\u00e9dure dite &lt;a href=\"https:\/\/euipo.europa.eu\/ohimportal\/fr\/fast-track-conditions\" data-cke-saved-href=\"https:\/\/euipo.europa.eu\/ohimportal\/fr\/fast-track-conditions\"&gt;de \u201cfast track\u201d,&lt;\/a&gt; qui permet de r\u00e9duire le temps de proc\u00e9dure de 6 \u00e0 4 mois. La marque est publi\u00e9e tr\u00e8s rapidement (en moins d\u2019un mois), car le titulaire a choisi un libell\u00e9 (liste des produits et services) qui ne contient que des expressions pr\u00e9-agr\u00e9\u00e9es par l\u2019EUIPO. L\u2019examen de la demande est donc facilit\u00e9 pour l\u2019office, qui peut plus facilement acc\u00e9l\u00e9rer la proc\u00e9dure.&lt;\/p&gt;&lt;h3 class=\"ckeditor\"&gt;D\u00e9poser au dernier moment&lt;\/h3&gt;&lt;p&gt;Certaines soci\u00e9t\u00e9s \u00e9voluant sur des secteurs ultra-concurrentiels doivent imp\u00e9rativement prot\u00e9ger leur marque le plus t\u00f4t possible au cas o\u00f9 il y aurait une fuite vers un concurrent. Mais dans le m\u00eame temps, elles pr\u00e9f\u00e8rent d\u00e9poser le plus tard possible afin de repousser au maximum la date de publication de la marque, pour que leurs concurrents n\u2019en aient connaissance qu\u2019au dernier moment. Il est en effet commun que les soci\u00e9t\u00e9s d\u2019un m\u00eame march\u00e9 \u201cs\u2019inspirent\u201d les unes des autres, ou contrecarrent la communication sur un nouveau produit adverse en sortant un produit similaire au m\u00eame moment. Or, il est important, dans ces m\u00e9tiers, de conserver une longueur d\u2019avance sur ses concurrents.
